CA CIS, I-140 EB3, Concurrent, Substitution Case

Hi guys,

my I-140 petition was filed in the EB3 category for a labor substitution case in Aug 2003.

Now CA CIS says they are waiting for the original certified labor certification from the national records center. That was many months ago.

Do any of you gurus out there know whether this national records center is a veritable black hole from which nothing comes out? Or is there hope yet? Is there anything that I can suggest to my lawyers that they should do in order to overcome this hurdle?

Was there a I-140 filed for the original petitioner?? Looks like it was. That is why the Service Center wants to retrieve the original LC which would have been filed with the original petitioner's I-140 and place it in your file to complete processing of your I-140. I don't think you or your lawyer could do anything in this regard. Its just a waiting game with the hope that they (CIS) would pull out that old file (it should be with them only since USCIS only processes I-140s).

Thanks..I am not sure if an I-140 was filed for the previous petitioner..maybe thats something I can ask my HR dept. In the meanwhile..I guess its back to waiting and waiting and waiting...and then some more waiting. Ah well..at least my AP and EAD got approved.
