Atleast it moved by a year ... EB3 IND

All,

I guess its good that the date jumped by a year for EB3s IND. They must have felt ashamed when they found out that there are only a handful of 98,99 and 00 cases and figured that they would move the date to 99. Leaving it at 98 would have made them feel really guilty.

It would have been better if it had moved to 00 or 01 :). Anyway, lets hope that the current bill in Congress is passed this year and everything becomes current in Jan.

I guess some progress is better than no progress.

I dont think that this is a progress at all . Infact ,it is a slap in face of us . Every quarter are they not supposed to release a part of 140,000 ? If yes , can they tell us the numbers because I am pretty sure that by the end of December these numbers are not going to be met !!Oct-No-Dec is the first quarter for USCIS . How many visas did they issue in the first quarter ?
I think we must report to Ombudsman..

Sry , but I am really pissed off.
 
I wish they could have moved to september 2001 and start approving GCs for both Eb2 and Eb3. It doesn't make any sense to move priority dates with this speed... Why they do like this..

I140 approved = Feb. 18, 2005
I485 approved date == ???????? LUD changed May4, 2005 after FP, Lud changed July 1, 2005, July 5,2005.
FP = May3, 2005 (code 3)
EAD1 RD = Oct. 8,2004 Approved November 10,2004
AP1 RD = Oct. 8,2004 Approved November 16,2004
EAD2 RD = Sep. 1,2005 Approved September 8,2005
AP2 RD = Sep. 1,2005 Approved September 9,2005
 
India moved a whole year! WOW.
The rest of the world (all chargeability areas) moved just 15 days!!!! unbelievable.
I now see my hopes of getting GC for christmas going down the drain...
One deception after another. USCIS sucks!!!

I do not understand if or how this will affect my son CSPA/or not

Attorney is still saying he is protected and may need through appeal/litigation and working on case

Do you know;

1. If son has aged out (1st I 824 sent Feb 2002) what date would his visa be available? Employment based for son over 21years, unmarried

2. Would his priority date be when hubands I 140 was approved or when his
I 485 was approved?

File was sent to Texas SC.

Should husband write/do I 130 for son even though he was always "To follow to join" or just write to TSC?

I understand your frustration. I am not estatic that the dates moved to 99 but if they had stayed at 98, I would have felt worse. You bring up a good point about the new 140,000 visas available this fiscal year. Where are they going? Based on postings in this forum, 485 approvals have pretty much ceased for the past few months. There is no telling as to what is going on? It is a fact that there aren't to many 99,00 cases out there. There might be a few thousand 01 cases but why are the dates still in 99.

I do not believe in conspiracy theories but situations like these make me wonder about the political motives that may be behind these things. It is very possible. This retrogression has done wonders to the processing times for Service Centers. They are not working to much these days and the dates are flying ahead every month. This situation is all to fishy ..

This is another hoax from USCIS. How exactly are they getting these dates?
How many cases did they approve and how did they move the date to 99?
Come on, I cannot understand people being happy about the date moving, whereas it shouldn't be retrogressed so much in the first place. I don't know what kind of scam these people need to be punished under. By all means this is false reporting and unless we take it to the next level there is not going to be any solutions.

I never read any where AC21 is valid only for next 3 or 4 years when they released it. How can they stop using AC21?

Let us assume there are lots of cases pending for approval from 99, 2000, 2001. Some still being in LC process, what is the rule in moving the date moved forward? If their background check etc gets delayed, they may not get to the number of visas allotted for each country for that year. This then needs to be passed on a bill from Senate to recapture them back. And no one knows how long that will take. So realistically unless something happens with the bill that was discussed during last week there is no real hope of getting GC in a reasonable time of 3 or 4 years from the start.

Hopefully things get better next year. I think mailing ombudsman is a good idea to question why is the date retrogressed this far? What is the real number of cases pending for that many years? How are we going to overcome this?

Susan,

I am not completely sure of whats going on with your sons case because it is a bit complicated. However, I do know that dependents ALWAYS inherit the PD of the primary applicant. The PD is always the date the Labor was filed. Is your son considered a dependent tied to your husbands primary application? If so then his PD will be the same. Again I am not entirely sure of your exact case details so I cannot say for certain what is going on.

Thanks for that.

My husband filed I 140 Sept 2000 and dates were current. The I 140 was approved May 2001 and current at that time

From what I understand my son (if aged out) should retain this date

but now I need to know what date or when TSC should be working on sons case and if I need to do anything eg I 130 or write to TSC

I don't know the complete details of your Son's case but I asked a question related to this situation (i think) my attorney and this is what she replied.

The age of dependent will be locked the day I-485 filed. If he/she's minor (<21) on that day, then no problem.

In my case my son is here in USA with me - FYI

I hope my son can claim father's I 140 proirty date or when sons I 824 was filed but I am confused as to How to find out (If son has aged out/still waiting to hear) what date the TSC is working on for unmarried children over 21years for LPR's form the UK

Does anyone know how I can find this information?
