:) There is no official confirmation of this. Sorry.

Hi Rajiv:
Have you heard the rumor that Attorney Murthy posted on her website that all I-1485 cases will be approved if pending over 180 days.
She said a memo will come out this Friday. Is it true?

Seems he knows about it too!

Of course! Until he sees the memo, he will say "there's no official confirmation" - because there isn't really any to this date!

That "180 days" issue was probably Murthy's conversation with the BCIS guy.

But he didn't say suprisingly, "no, I've never heard of it." He used a smiley face instead.
No official confirmation could be "yes, it's going
to be released soon". What do you think.

It is good to hear that Mr.Rajiv Khanna didn't say that was rumor. So we can still have some hope on this forthcoming memo!!!!!!!!!

Let me know what's your interpretation of his letter. Yes, he didn't point out it's a rumor,
I kind of think he knows about it. But he's not sure when this memo will be released.

Could be the "last way" BCIS can think of to clear the backlog. Think about it, they process a month's cases in 2- 3 months, now the processing time is over 19 months, that means longer and longer waiting time for 2002 cases. So they have to cut the RFEs to save labor. They don't need to release any formal rules, just loosen a little bit, will benefit us a lot.

However, for Nov and Dec cases still hanging, I think something is wrong, either your name is not being cleared, or your FP is expired, they set your case aside or they forgot your case, or your case is approved but sit on their desks, forgot to be submitted, or they are working on Jan cases. Who knows! This memo won't benefit Nov/Dec applicants too much, instead maybe worse, since Jan/Feb/March cases will be approved more efficiently, that means Nov/Dec will never be touched again.

What if your name is not cleared from FBI sequrity check? Man. there are way too many variables. Too many cards they can play!

Or they can say we are approving anyway!!!

If FBI can complete fingerprint check with in a week then why do they need months for other security check. I hate this name check, do they mean to say all Mohammed are bad and all Bill are good??????????????

Security check is good for the country but it doesn't help if the files are sitting in a corner in the name of security check!!!!!!!!!!!!!!

We must do something about it. Otherwise nobody will ever help us. Let's talk about a way.
Anybody has suggestions?

It is not only that. They will send your documents to you home country. (In case CP it is Police clearance they get it from embassy) That will take around three months. That is done after finger printing.

Sure ! Lets have a big party on friday, where we all get drunk and forget about GC, what GC? :) :p  :D

That's really bad news then. You still need a job.

Have they been any cases where the employee couldn't provide the paystubs but was able to show a employment lettet, etc and still get the 485 approved.

memo??

Hypothetically lets say the memo is released. Does this alter timeframe for approval? Recent trend is 18 months to get approval so once the memo is released the approval time frame will automatically adjusted to 181 (6 months - 12 montsh)?

Reply from Murthy.

This is in response to my email to Murthy's office.

Dear Umya:

Thank you for your eMail message. Our office will be sending our a separate clarification and explanation because quite a few people were very excited and modified the answer to suit their case. << There is no automatic approval possible ever with the government. >>>>

SO THERE IS NO AUTOMATIC APPROVAL...

I don't know why some ppl think it's automatic approval immediately, I thought the best case is
approve you no matter if you're jobless or not.
But in the end, it's nothing but reiteration of the AC21 law, which we already knew.
