My RIR was denied by Boston in the middle of Sep. 2002. Boston received my case at the beginning of Sep. 2002. It is fast to get denied. The person who works at Boston Office told me all RIR related to COMPUTER occupations were denied. I didn't ask other careers. Any buddy is on the same boat? Good luck to others!

I don;t know how accurate this information is since there was a few postings in this forum recently showing boston dol approving software RIR petitions. Anyway I have seen a few RIR denied cases too.

Do you what is the next step for ppl who got their RIR petition denied?

thanks

Hi, Goku,

Thanks for your response.

I don’t know how accurate either. But I was told by an officer who works at Boston Office on the phone. My RIR was denied at the top of September, 2002. After denied by Boston Office, my case was bounced back to the State Office. State Office made an instruction to require publishing one more ad again. If I follow it to do that, under current job market, tons of candidates definitely can be found, and then the result must be that my RIR will be denied again.

Any different thought or idea?

Notes: The above is just about my case. Definitely, your cases will be different based on the different occupations, states, and periods.

thanks.

Software Engineer – RIR Denials everywhere

What is up with Software Engineer category DOT code: 030.062-010 ? I have seen so many cases denied for one of our subsidiary company. I got a response via DOL e-mail system, and trust me I saw at least 6 denials for RIR cases, all of them from Dallas DOL (Region 6) office. Most of these cases were denied in year 2002 (Aug-Sep). Rest of the categories are approved ex. Programmer Analysts, Database Administrator etc by the same office. We announced some lay-offs last month, but these cases are denied before the announcement. And the strange thing about this whole deal is that all the denied cases are only Software Engineer category (RIR). I have no clue what is going on. And as you guys are suggesting that similar kind of stuff is going on at Boston DOL office (Software Engineers are getting hammered). Any thoughts?

P.S. Thank GOD, I am not a SE.

Hi, RamFan,

The DOT code is 030.167-014, computer or software occupation related. I GUESS (just GUESS) that DOL want to make unemployment rate lower. We – H1Bs – are not counted to this rate, whatever we have jobs or not. So DOL has a DREAM – replace all of H1Bs to push unemployment rate lower. Unfortunately, there are too many H1B dudes in these areas related to computer or software. And then the axe is coming. Then what? Your fate will be in the hands of State Office.

RamFan, I am very glad to exchange the information with you. But I am sorry, I have to say your last words – ‘P.S. Thank GOD, I am not a SE.’ SHOULDN’T be here. It just makes the most of SE H1Bs sick.

Thanks.

No offense

FallColor,

I didn’t mean to offend or discourage anybody. It was just an expression after what I read here. How about I rephrase it for you: “I have to see what happens to my case btw I am not a SE”.

I do understand the frustration and pain this sc*** up LC process can cause. Trust me, I am one of the guys who spent $1000’s on premium education in U.S.A, and busting my a** for last three years now stuck here obtain LC.

Hmm, don't u guys think that it is all related with "higher scrutiny for RIR cases" memorandum?

Anyways, is this going on with RIR cases only or "Normal" processing too? Any ideas how many regular LC cases denied for IT ppl (not just software engineers)
