Hi, here is a case of my friend and he's wondering what he should do right now:
*BACKGROUND*
- Current Status: F-1 (OPT)
- He's been working for a private company as an intern since early-June, and later he got a permanent job offer, his boss agreed to pay him & sponsor H-1 after completing his 200-hour internship, so he's supposed to get paid since mid-July, however since he hadn't received his EAD at that time, his boss agreed to pay him once he received the card.
- Received his EAD on 8/7, however the EAD is valid from 8/25/06 to 8/24/07.
- On 8/8, he notified his boss that he received his EAD, his boss asked him to fill out the W-4 on the same day.
On 8/11, he received his first paycheck which is dated 8/15, however his EAD is not valid until 8/25. His boss said it's not a big problem, however my friend is hesitating right now - should he cash the paycheck? Should he ask his boss to void this check and not to issue him a paycheck until 8/25?
Would this mess up his H-1 application?
I have no experience in applying H-1 so I can't give him any advice. Any advice from you guys would be greatly appreciated
