Hi,
My Father-in-law has applied for his I-485 based on family. He was born in year-1944. We've furnished two affidavits to support this. Apparently there is a RFE regarding his Authoritative document from Government regarding on his proof of birth.

While pursuing for his certificate in remote village in Homeland in India, we discovered that his birth was indeed recorded/registered and add to our woes it was incorrectly registered for a day more( example instead of Jan 10 the date is recorded as Jan 11) than All his other documents( passport, drivers liecense, marriage certificate and affidavits)!!

Also he has travelled to US back in 1960's on business purposes.

So, date of birth on his official birth certificate doesn't match his PASSPORT, International Drivers license and affidavits to support his birth!!

We're clueless what to do??!! Can we submit his Birth Certificate which is not matching? will this jeopardize his I-485? TIme is running out for us..Please respond in case you have creative ideas how to handle the situation!

so, he has the original birth certificate from 1944? or not?

If not, submit a NABC from local municipality where he was born and this needs to match his place of birth in his passport.

Yes, we've Birth certificate now, however the date of birth on the birth certificate doesnt match his PASSPORT/Affidavits/other documents.

We can not get NABC, as his birth is recorded!

issue: date of birth in Birth certificate doesn't match date of birth in Passport/and other official documents

Go to a different city/district to get a NABC !! You can show them the Notarized Affidavits and they will issue a NABC . The Affdavits will serve as the official date of birth. What is the native country issuing NABC ?

Why are you suggesting fraud? The birth certificate is quite available, from what it seems.

I'd supply the BC, and mention that there has been an error in the dates your FIL has used all this time. The fact that the date is off by a day isn't the end of the world.
