Birth certificate question for I-485

My I-485 is pending with Vermont center since Jan-05. When we filed I-485, we didn't have my wife's birth certificate, which we have now as we had to get it from home country. Since this birth certificate was prepared recently upon request by municipality, it has recent (creation)date on it. Would this be a problem?

Also, what do you guys suggest whether I should wait for RFE from USCIS to submit birth certificate or is there any address to which I can send rather than waiting for an RFE? Will it be lost if I send w/o RFE? We also didn't submit our medicals while filing for 485, should I send medical reports seperately now or again just wait for an RFE?

My PD is March 2004. Any idea when my I-485 will be approved? FYI: I-140, EAD were approved in Feb-2005.

There are people who got RFE for late registration. They had to provide secondary evidence - like affidavits and school certificate. But there are people who got approved with late registered birth certificate. I think it depends on the service center and adjucator.

Better to wait for RFE.

Pralay, thanks for the response.

Follow up question: What do I need to submit for affidavits? Once I know what do I need to get for affidavits, I should get that ready and upon receiving RFE, I will submit 'em along with birth certificate (which has late registration date). please advise.

Also, my PD is March 2004, application is pending with vermont center. Any idea when my 485 will be approved? After oct-2005 or do you think wait will be longer than that?

-------------You need to submit 2 affidavits from parents of your wife on 10 rupees stamp paper signed before Notary or executive magistrate. Affidavit should have your wife mothers name, fathers name, her DOB, place of birth, her maiden name and that she got married to XYZ on date and after marriage changed her name to CCCCC. Her DOB, place of birth should be same on affidavits as on her passport and DOB certificate. her parents can go to local court or any lawyer he will do that. when RFE get RFE submit only Copies of both affidavits.

---------------It seems you belong to India if your case is EB3 then many layers guess is that EB3 for India may NOT be current in octbor 2005.
After oct-2005 or do you think wait will be longer than that?
-------------if EB3 and PD of 2004 it may take longer than oct 2005
