Birth certificate query

Guys, I am filling I-485 family based and I have a question regarding birth certificate.

I was born in India in 82; however, my birth was registered with municipality in 1992. I never needed a birth certificate until my father filed a I-130 in 2004. So a birth certificate was issued to me in 2004.

Now, I am trying to avoid any future RFE's from USCIS, so my question(s) is/are:
1) Do you think USCIS will ask me any supporting documents regarding my birth certificate?
2) If yes, then what kind of documents can they ask for, and if I submit those documents along with my I-485, would it be OK???? or would this make the IO more suspicious?

I have read in many posts that usually when there is an RFE issued on birth certificate, they generally request: 1) School bonafide certificate
2) Medical records
3) Affidavit from parents regarding the birth date.

I am in possession of School bonafide certificate and medical record, but it only displays my father's name and not both parents as I am sure most people are aware, in India, they generally don't mention mother's name in school certificate or medical records.

What should I do? Can I submit my school certificate and medical records certificate along with my birth certificate to avoid RFE?

Any suggestions please.

Guys pls reply. Did anyone ever get a RFE on birth certificate with different registration date than their birth date.

I am sincerely awaiting someone's advice.

In India it became compulsory to register all births from 1971, I am not sure how your birth in 1982 never got registered immediately.

To be proactive, you can include affidavits from close relatives in addition to the late registered birth certificate.

I was very surprised to find out last night as well that my birth was never registered in 1982.

Anyhow, can my parents provide these affidavits and if so, what should they write in these affidavits (does anyone has any sample affidavits or some wordings that it should include).

What about those school certificate and medical certificate? Do you think i should include thsoe with my I-485 or I shouldn't be that proactive to make IO suspicious> What do you say?

Google "sample affidavit of birth" and you will find plenty of examples. Your parents can make these affidavits but they will have to be notarized. It should include their full name, their date of marriage, your full name, your date of birth and a statement about not getting your birth registered on time. Other evidence like school records, etc. are not required. You should include copies of affidavits and copy of the birth certificate with your filing.

Thank you very much for your suggestion. I already got the affidavits from my parents. Just have to get them notarized now.

quick question nkm-oct23, Can my father (petitioner) also submit this affidavit or as a petitioner he's not allowed to do that? Please clarify????

Also, if my father (as a petitioner) cannot submit this affidavit, then can i request my sister (3 years older than me) submit an affidavit on my behalf?

I really appreciate your invaluable advice. Thank you soo much.

I don't think there is a problem if your father (petitioner) submits an affidavit. If your mother is unable to submit an affidavit then any elderly relative (uncles or aunts) can also make the affidavit. The person making the affidavit should have been old enough to have first hand knowledge/awareness of your birth.

thank you. I got both signatures (ie. father and mother) and notarized copy of my affidavits.

Does anyone know if we can staple the applications (like 6 pages of I-1485 and 5 pages of I-864EZ and IRS tax transcript) or should we keep them in loose papers. I read on USCIS website that payment should be stapled. They don't make a mention of if application can be stapled or not.

The reason why i am asking is because if they keep these documents in ACCO folders, then they might need to remove staples for easier access. Just wondering how you guys submitted your documents.

BIG THANKS once again. This forum and it's members are great and extremely helpful. May GOD bless you all
