Birth Certificate / Non availibility Certificate issue

One of my friend is expected to get his LC with in next few months. After that he will be needing Birth Certificate or Certificate of non-availability. Its not possible to get either one of them, Only an affidavit from mother can be made available. What he can do to meet INS requirments.... any comment please.

--- Why it is not possible to get? What is the reason? One can get non-availability Certificate from municipality or from district registrar of birth records or from village panchayat, and if it is in not in English get it translated by any notary in English as “ true copy”

---- He/she need 2 affidavits+ non-availability certificate, one can be from mother and one can be from any other relative who is elder than your friend like uncle, aunty, or any relative. If your friend is from India mother and any other relative should sign 2 affidavits on 10 rupees stamp paper, go to court any notary or lawyer will do that.
 
He is from Islamabad , Pakistan. Its not easy to get any kind of certificate from govt. organizations there and he has no body who can go there and persue munciplality people.

He has a citizenship Form B which is issued by Govt and it includes Date of births and names of all family members and its not in english but I believe Embassy in US will translate it for him.

I asked bcaz i wanted to know if nothing works his way then what would be the worse case scenario?

---- USCIS needs these documents as I wrote in above post and Pakistan is not a country that cannot issue these documents, if you cannot get EASILY that is your problem USCIS is not going to give special treatment to you being from Pakistan

In my case..I have a orignal birth certificate. But It doesn't have my name becauseI was not name by that time they took it.Will it work. Is it valied. Please let me know.....

you need the birth certificate with correct name as it appers on your passport. Name and DOB should match with passport details.

you also need 2 affidavits+ non-availability certificate

OR get your Biith certtificate corrected

BC based on Passport and obtained from Consulate or Embasyy is NOT accepted

---- If birth certificate is in native language then get it translated in English any notary will do it on 10 rupees stamp paper and will stamp it is True copy or True translation of Birth certificate of XYZ from Hindi or Punjabi or Tamil or Telgu to English
Keep that original notarized copy with you and attach the copy of English translation and copy of native language certificate when you file I-485
**It can also be translated by your friend in US who knows both the language and should sign before Notary that he knows both the language and should provide his name, address and sign the document before notary in US (all bank in US have notary)
** The translation on 10 rupees stamp paper and Notary seal from India gives good impression to USCIS but unfortunately they don’t approve I-485 easily they are taking around 3 year and don’t know how much delay will be in future and many may go back to India as IT in India is growing and one will not be called” Alien “

for this information .I have similar problem .my LC is approved last week I have to apply for concurrent filing I140/I485/EAD
I have a birth certificate but my father last name is not there only first and midde name ,but my DOb and name is correct also on my passport there is a different birth place and on my birth certifacate birth place is different .Please advice if there will be any problem coz of that .

Can i go ahead and file my I-140 and later on when i get my BC corrected then file I485 and EAD.
Will it be called concurrent fileing or seperate as i know to correct BC will take at least 10 days .

--- I-140 has to be filed by Employer and no BC is required to be attached with I-140

and later on when i get my BC corrected then file I485 and EAD.

---- once you get I-140 filing receipt then file I-485, EAD, AP with Birthcertificate documents attached with I-485
Will it be called concurrent filing
---- it will be concurrent as you will file I-485 with I-1 -40 filing receipt, if you file I-485 after the Approval of I-140 then it will not be concurrent filing

or seperate as i know to correct BC will take at least 10 days .

---- If the correction is going to take 10-20 days I would file I-140, I-485, EAD, AP at the same time, you are not wasting much time if you get the BC papers corrected in 10-20 days. Go for the correction and mean time collect all other documents to file for I-140 and I-485, lawyer can start preparing the I-140 and I-485 forms and lawyer takes time and I hope you will get all required BC documents corrected then lawyer have just to attach the COPY of corrected BC OR non-availability certificate+ 2 affidavits ( submit only copy and keep the Original with you)

After much bargaining with my employer, we are finally ready to apply for I-140, I-485, I-765 simultaneously. Now I am in the process of collecting all the necessary documents to attach with my filing. http://www.immihelp.com has been my primary source of information in the process. Looking at the I-140 application information (at http://www.immihelp.com/gc/employment/i140.html) I don’t see any references to BCs. Now I’m confused.

What are the documents I need to attach to my I-140 application? I am aware that experience letters may be necessary - here again it isn’t clear whether my old experience letters (that I procured for other purposes) will do or do I need to get fresh, recently dated, experience letters?

Also, since the filing will be concurrent, are the documents required for all three applications the same?

My employer is no good for getting these details from, as he is inclined to drag his feet at every opportunity he gets. You can imagine the frustration.
