Birth Certificate for NIW CP at Mumbai

Hello friends,

For our NIW case, we plan to attend CP at Mumbai.

1.In my wife's BC, the month of birth is wrong,instead of July, the certificate says it is June. All her school records and passport correctly mention it as July.

2. In my BC,for the place of birth, the local area is mentioned instead of the name of the village/town. The rubber stamps of the municipal officer do mention the name of the village/town though. My passport mentions the name of the village/town.

Can we solve all the above problems with affidavits instead of going thru the municipality again?

For Problem#2, affidavits should suffice.

Problem#1 seems complicated. The consulate normally believes more in birth certificates than the data on secondary evidences like passports, etc. However, you may try getting a correct birth certificate from the Indian consulate in your area PLUS get three affidavits (atleast one from her parents).

A) Try gettting a new birth certificate with correct date.

B)If that is not possible then get 2 affidavits of birth with correct birth dates plus 2 school leaving certificate which dislays correct date of birth.

Preferrably option 1. A. Affidavits from Indian consulate are not accepted as they issue affidavits based on passport date of birth which is a secondary form of evidence!

Problem 2:

A) 2 Affidavits of birth with details of place of birth!

Remember affidavits should include all of the following:
1. Full First Name of the child
2. Full First and Last Name of each of the parents
3. Place of birth
4. Date of Birth, preferably spelt out in words as opposed to mm/dd/yyyy or dd/mm/yyyy which can add to the confusion.
 
Another problem is , I lost MY Original BC and I have only the photocopy with the above mistake. Getting another Original is extremely difficult as I dont have any folks staying at my native place. Will affidavits work? Or do I need to run for another Original?

On the basis of your copy, they (authorities in India at your birth-place) should issue you a duplicate one. Get it translated into English if it's not in English (highly likely).

In the consulate, while collecting documents, they see the original and keep its copy with them.

The consular officer takes photocopies after verifying it against its original. So in essence, you will definitely need th original BC.

Based on your BC photocopy you should be able to get a duplicate issued from appropriate authorities. REmember you have to have duplicate/ original BC at the time of the interview. Affidavits alone with photocopied BC and no original BC will nto be accepted.

Ask you friends/ relatives to arrange for a duplicate BC prior to your interview.

There is yet another option although not fool-proof...

IF you have school leaving certificate with your birth date and you carry affidavits along with photocopy of your BC that should work.

To play safe, make a photocopy of your BC photocopy and get it notarized from someone and carry it along with affidavits and school leaving cert which has your birth date!! This may work!!

Contact uvwxyz...he is in a similar situation!!

What is with the notarization? Do I need to go to the official notary? Do I need to get it on stamp paper? How much worth?

I will check with uvwxyz incase I can get hold of him.

Notarization means taking that photocopy to a notary public and attesting on that photocopy it is a true and fair copy and getting that notary public's seal and signature on it.

Normal custom is that if you carry a notarized photocopy of any doucment one does not need to show original documents. Not sure if this custom is true with cp interviews for GC coz the appointment letters normally state carry photocopies and originals and photocopies will be kept by consulate after verifying against originals!!

Although i have suggested this option I can say that this would have been my last option. My FIRST option and the best option would be to get hold of a new duplicate BC somehow!

When they specifically ask to carry both originals and copies,they definitely mean originals. Else,they might mention notarization.

I will try to get the duplicate. Better to be safe.

When do you expect your interview ? My I140 just got approved on Jan 14, nothing yet created in NVC. So I expect a July interview. As for Birth Certificate goes since I am having time I am going to see if I can arrange the BC or NAC from the authorities in India. But I had one of my friend who just had his AC140 interview completed successfully. In his case his wife's BC was not their so Affidavits and other documents worked in their case.
But as Raju has mentioned whats the guarentee that it will work in our cases also..So I suggest if you have time then get the neccessary documents otherwise go with whatever you have. In worst case they will ask you to comeback with the neccessary documents.

Just filed our NIW, so,I just cannot imagine as yet about the interview.

Is your category NIW as well?

It is absolutely correct that different cases might be treated differently at the discretion of the consular officer,UNLESS there are some written guidelines about these in the laws( which we are not aware of).

The case that you have mentioned is that of AC140 which might have been treated differently in which her affidavits have been accepted.If this is done on a regular and consistent basis for ALL categories,then we can relax.

Anyway,try to find out more about this if you could.

It really does not matter whether it is a AC I-140 or a regular CP case when it comes to whether an original/ duplicate BC is required. It is just a matter of whether the consular officer is convinced with other provided documentation related to birth.

That being said, it is better to be safe than sorry since this is such a a grey area. So try your best to get the duplicate BC/ NAC as the case may be!!
