birth certifcate for my I-485

Hi,

I need birth certifcate for my I-485, I donot have one and I cannot get one so my question is what kind of papers should insted of birth certifcate.
 
Birth Certificate for 485

You can get an affidavit which is given by parents. Here is the format. Your father has to get it typed on a stamp paper and notarise it.

(AFFIDAVIT WHEN BIRTH WAS NEVER REGISTERED)


I, 'FatherName' s/o 'His Father Name', Hindu by religion and residing at 'full adress' , do hereby solemnly affirm and state as follows.

1. Ms 'mother name' is my wife
2. Mr 'your name' is my son born to me and my wife Ms 'mother name' on the 'date of birth' at 'full address with the hospital name'.
3. It is further declared that birth of my said son 'your name' is not registered in the birth register of Municipality of 'your city', as it was not mandatory to do so at that time.
4. All that is stated above is true to the best of my knowledge.

The indian consulate gives a birth cirtificate based on the info on the passport. This is the link to the application form.

my lawyer has sent me a format which differs only slighty. He also said that it need not be notarised. Is notarization necessary?
 
Affidavit format

Affidavit format can differ as it done by different people at different times and as there is no mandated format. The bottom line is it should contain all the information regarding you(your name, your father,your mother) , your birthdate, place of birth. It should further contain some information regarding the person who is stating/swearing the information like - person's full name, full address and also the relation to you.

Normally affidavits are done by Mother and father. Mother is more important than father as she is the one who is giving the birth. In case you do not have parents, then you could get affidavits from any elderly person(relatives) who knows about you, your birth and your parents.

Further, you should submit a non-availability certificate from the local govt. body in your town/village. In India, this is a standard form and is available. Normally it is signed and stamped by the secretary of the local govt. body.
 
Hi PJSReddy.

Could you please let us know if you have any personal experience with Birth certificates issued by Indian Consulate ?
Like got REF or lawyer denied it or you read somewhere from INS web or from documentation from INS.

Get Non avalibilty Certificate + 2 affidavits

Get Non availibilty Certificate + 2 affidavits from parents or relatives. all the 3 documents are VERY VERY important. got my GC approved after submitting the 3 documents in repsonse ot RFE issued for BC
