Either option you mentioned should work. Affidavits along with either the Non-Availability certificate or a late registration birth certificate. In fact you do not need affidavits if your hospital certificate contains your name, date, your parents name and place of birth. But it does not hurt to get affidavits as well.

I have found that it is easier to get a late registration certificate than a non-availability cetificate. Many offices hesitate to issue non-availability when they have procedure to do a late registration and issue certificate. But some offices would issue you either.

Ideally you should go with what your lawyer asks for. But if I were you, I would ask lawyer to use the late registration certificate. That way you get a certificate you can use later for other purposes as well.

Hi Kanadian

I don't know about your country of birth.
If you are from India, getting a non availability certificate from local
township is easier then doing "late registration".

Even for "late registration", first you should get a non availability certificate
from the local township office and then you have to apply in local court
for this through a lawyer. They have to run some adds regarding this in local
news papers. After 2 months court will issue birth certificate. Minimum you
have to spent Rs 5000/- on this.
On the other hand for non availability certificate you need to spent around Rs500/- as bribe and you will get it in a week.
This is my experience.
I think this will help you to decide.

My wife too had the same situation. We submitted the cert from Hospital. Got a query asking us a cert from civil authorities. If you show the cert from Hosp to muncipal office in India they would give you cert easily but it costs a little.
By the way, I also subimitted two affidavits along with cert from civil authorities.
Hope this helps you making a move

According to my attorney I should not submit Birth Certificate of new date....he said they like to see something issued at birth time or No Record certificate...well I have to see what my family can get for me from Pakistan. we have B Form which list parents name with all kids details so its like family tree so I am planning to submit that with true translation and also trying to get No Record certificate.
