Hi Gurus,

My 140 got approved on March 2005 and 485 is pending for more than 17 months under EB2 category.Got laid off.changed jobs twice with EAD and Ac21.Got Biometrics code 3 on september 2005.Now my question is Eb2 is retrograted,without visa availability how can they adjudicate 485.But one of my friend got Biometrics code 3 and got PR card directly mailed to his home address.

How is it possible??

It's possible if:

(1) It was approved before Oct 1, 2005. Prior to that date, EB2 visa was current and availiable.

(2) His/her country of chargeability is other than India or China.

(3) His/her priority date is before the cut-off date as published.
