Biological Parents Petition: Adopted Child Became An Adult

This is not an usual case. However, it is important to our family.

My brother and I were adopted to my uncle's family that owned US citizenship when we were approximately 10-15 years old. At that time, we lived with our biological dad and grandmother. My biological dad was suffering mental illness, so that was the main reason my uncle's family adopted us.

Soon after my brother and I came to US, we got US citizenship. Now I am studying in my mother's country but I and my brother are both planning to live in US for our entire life. Of course I will go back to US as soon as I graduate.

When I go back to US, my biological dad has to live alone, still suffering the same illness. I and my brother know that he did not give up on us, he wanted us for our best chance. My hope is I take him with me when I come back to US so that I can support him and get him a proper cure.


Sorry for the long story. So the question is, now I would like to recover the parent-child relationship with my biological dad and petition him so that he could come to US and live with me and my brother, receiving proper cures and getting out of the main cause of the illness. Would this be possible? I am 22 years old now and want to support my biological dad.

Not possible. Once the adoption process is complete, the biological parent loses eligibility for any immigration benefits based on the parent-child relationship, unless the adoption is revoked and parental rights are restored when the adoptive child is still a minor.

And even if he could immigrate, you might not be able to afford the exorbitant cost of his health care in the US. It may be much more affordable to hire somebody to take care of him there, and assist him with other expenses where he lives.
