This is the Democratic equivalent of all the Tancredo-type bills that want to halt all immigration and send everyone who was born outside the US to an internment camp. They're political theatre, and a waste of time.

I just read the bill. Seems like you have to be ILlegal to benefit from it (with some exceptions). You don't have to be employed for 5 years, but a total of roughtly 2 years (more exactly, 530 workdays) in the 5 years preceding the enactement of the Act.

For non immigrants, such as H1's, "The alien must etablish that the alien's period of authorized stay as a non immigrant expired before such date through the passage of time". No sure is "such date" means the enactement of the Act (i.e. the day the law passes) or the date of the application.

I wonder if one's H1 has expired and one in AOS status, if one can claim to qualify under this paragraph. I am going to ask my lawyer in a couple of weeks and report on that in this thread.

Within 2 weeks of being introduced, the bill has gathered 15 Co Sponsors. The bill is also very similar to HR 440, introduced by Luis Gutierrez a while ago, and that has 17 Co Sponsors. I believe some of these 17 will join Gephardt's bill. I am fairly confident this some version of this bill will pass in 2004.
