BF is Swedish. Entered US via VWP in 2001. Married, but never filed for any adjustments to his status. His wife fell off the radar. He stayed in the US. We met in 2004. He moved back home to Swe in June 2005. I got a perm residency and followed to Sweden in fall 2005. He is still married to his 'missing' wife.
1) How do we find out for sure that he has been banned from re-entry?
2) He is in the process of divorcing his current wife so that we can marry. I want to return to the US (with him). Has anyone had any success in obtaining a waiver to a ban?
there are so many facets to this situation that are screwed up that I just don't know where to begin...
