Beyond 7th year H1B extension

Hi All,

Could you please advice me in order to extend my 8th year H1B with new employer, my labor with new employer should be pending 365 days before 6th year completion or it should be pending 365 days from the filing date?

Please advise me asap since my 7th year H1B is valid another 2 months only.

In my opinion, it should be pending 365 days when you apply for extension. As you are applying for 8th year, the LC should have been filed atleast by the end of your 6th year on H1 (and not 5th year).
Make sure from your lawyer though.
