Bench on H1B, Staffing firms...

It seems that ALL the software engineers who are employed with the Indian consultancy companies have been "benched" some or the other time.

And the desi staffing firms have done their research and come up with ways to get away with it...
If asked consultant employees, the hapless people are "trained" to tell that "I was on vacation" or something like that to get away with bench time!!

It’s amazing how desi staffing firms take all that risk, exploiting the loopholes of the visa rules...
I really admire the nerve of these desi recruiters...they have spoiled the whole job system in the job hub states of the US and have made life hell for so many innocent people...and I am not exaggerating...

B'coz when the going is good, everything seems fine, once caught, it will be deportation and nothing else...and the desi staffing firms might get away with some fine, bribe someone and get away or something

In most cases, the employers would be citizens…so they will be safe to large extent...wow what a racket!

But these people go to any lengths to make an extra dime more by skinning the Indian engineers...true American spirit "buck is a buck", huh??

I can’t understand why the "client" companies who these engineers really work for (work on a project) can’t go ahead and hire these people directly...

What are they afraid of?
Maybe they don’t wanna be known as a company that hires too many immigrants, foreign labor, cheap workers or whatever they care to call these people...all the major firms are already being criticized big time for this! I will not believe that they cannot afford to keep all these people as direct hire employees…there are very big companies who take the consultants from desi staffing firms…Why should they do that?

I don’t know how far the consultant employees (Indian engineers) of such desi staffing firms understand the seriousness of the visa rules violations they are so casually talking about...they just smirk about it!
They are just lucky, that's all...

In their desperation to stay in the US, they are simply falling prey to such people...its pathetic…

They are being royally used by both the desi staffing firms as well as the client companies:

1) Low pay
2) Splitting wages between 2-3 middlemen
3) Forced to violate visa rules: benching, lying etc.
4) Abominable contracts that don’t make sense
5) Forced to relocate, separation from families
6) Constant threat to stay with the desi recruiting firm to maintain H1B status..
7) God only knows what else…

Even the clients with whom the consultants actually work also use them...

1) They don’t want to hire these people directly but they desperately need them...
2) They are willing to pay exorbitant amounts for these foreign worker: I really don’t understand how foreign labor reduces costs as they claim...the total money/wage of these consultants marketed by the desi recruiting firms are quite high....
I bet these desi engineers would be more than happy to work directly for these clients on a full time job for the same net pay they get after all these job p**ps distribute amongst themselves...
3) When the project is over, they get rid of them…

Desi engineers are like the red headed stepchildren in this country....

Nobody wants them, cares for them really, but they end up doing lotsa work and kicked around in return...

But we do hear here and there abt the "Great contribution of the Indian 'minds' to the US economy, scientific research, medicine" etc., but those words does not solve the million problems of immigrants staying in this country does it???

And why would anyone want to help the immigrants anyway??? They don’t want any immigrants in the first place!!!

So its just dhobhi ka kutta situation!

I just hope these staffing firms sponsoring visas (no, wait, they ARE NOT sponsoring, they are simply SELLING H1B visas) is put to an end by stringent rules…that one cannot apply for a H1B visa if the employee is not working on a project on site with the same employer who holds the H1B...
That's the only way to wash out all this dirt and put an end to this menace...its simply ridiculous...

I see people complaining abt RFEs when they went for stamping....

I bet that 95% of these RFEs were for people who were working for these silly desi consulting companies who just put up a computer-ish name for the company and anything could be going on within them: I mean look at their names, it could be anything like SS Technologies, JJ Technologies, ARK Computer Solution LLC, SoftBizInfoSystems Inc. Ganesha Softek or whatever the heck...sick!

But what I DO understand is that the attorneys ARE very aware of all this. I want to ask them one question, if one is reading this...

Is practicing law only working your way around the law as it is, OR does practicing law also means that after seeing numerous people who run into problem, a good attorney’s work would be:
Identifying that the laws we first made is not working for us as we thought it would and should and must, and trying to make amendments to it...
There should not also be too many laws that you simply cannot live without breaking a bunch of them…

I hope something would be done in this regard!
We don’t have to wait to put up a speed bumper on a road ONLY after a dozen people get killed on that spot, right???

I totally agree with you. These consulting companies are not penalized for breaking the law. If the employee is not paid during the bench then the employee will be in trouble during GC or Visa stamping. Nobody questions these consulting firms for voilating the H-1B terms.

Things only change if the CEO's of these companies are put behind bars for knowingly breaking the laws.
