Becoming fulltime student while waiting for 485 approval

Folks,

I am tired of waiting for my green card (485 pending) :mad: :( . I have been planning to join a graduate school for a doctarate degree. If I want to join the school next Fall, what are my options?

Are there any risks in leaving GC process and going back to F1 (student visa)?

One I can think of is: dual intent (GC is permanent status and F1 is temporary status). I may get denied for F1 after knowing that I had applied for GC.

Any idea or suggestions about this?

Has anybody done something like this?

assume that u r full time student and get rfe for 485 asking for proof of employment, what r u going to do? if u dont reply in 3 months to this rfe ur 485 will be considered abandoned.

also since 485 is pending you wont get F1. you need to cancel 485 to apply for any new us visa. hope this makes sense.
 
This questin came up a coupl of months ago, and there were three different view on this. 1) Yes you can with no problem at all because the GC is for a future job that has nothing to do with your current studies or employment. 2) Yes you can as long as there is no visa available for you. As soon as a visa becomes available you need to quit school and take a job that is aligned with the LC and I-140 approvals (title, duties, and salary) so you can respond to the RFE asking for current letter of employment. 3) No yo cannot due to F-1 visa has the intent of not immigrating and not applying for GC while obviously you having filed an I-485 application your intent is to pursue a GC. No one actually knew the correct answer in that discussion thread, so I recommend that you approach an experience lawyer about this, and perhaps even the international office at the university you are considering.
