What was the detention about? Did you go to court and get a conviction? I don't know any lawyers in SF but I am certain someone here can give you a free consultation from previous people's experiences with similar situation.

It was at an illegal place and involved local police, ICE agents. After being detained there for a few hours, I was let. No court visit or conviction. No case for filed..

E,

This forum is one of the safest place to outline your situation and get differing viewpoints and you get to learn how each person analyze your case, their suggestions, NOT legal opinions, which will benefit. Was this at an employer who was known to hire illegal laborers? If so, are you that employer? Given the little information which you provided, unless ICE took your name and social security #, picture and did a finger print, I think you should be okay. Please re-read my last sentence, if that's what they did. However, if there are other factors which happened but you are uncomfortable sharing on this site, then my advise is irrelevant. For example, let us say that ICE came to my house and found that I hired 5 illegals to rebuild my basement, take the illegals and me to their office, keep me there for about 3 hours and don't "process" me in any way, except to let me go and keep the illegals, I am free and no record will exist of such a confrontation, unless they decide to take the matter before a judge and I am charged with violation of employment law. So, the more details you provide, the better for each person to evaluate your case, did I say for free? Plus offer you cogent advise on how to proceed or what you can consider.

I am reluctant to share details as I see lot of posts where rather than providing advice people start judging morally. Anyways, here are some more details..

More than 5 years I was at a house of prostitution. Police and ICE raided the place. I was handcuffed and detained for few hours. Some questions were asked about what I was doing there. They took my SSN to check my legal status as I was not carrying my green card. I don't remember being finger printed. After sometime they just let me go while they arrested the other people providing services at the house.

Time heals this wound on good moral character:

8 CFR 316.10

(b) Finding of a lack of good moral character.

(2) An applicant shall be found to lack good moral character if during the statutory period the applicant:

(vii) Is or was involved in prostitution or commercialized vice as described in section 212(a)(2)(D) of the Act;

It is only a temporary bar to naturalization.

E,

I won't judge your sexual exploits there...lol!!! I think then you might need a consultation with a lawyer, but the positive thing is that you were never charged with eating a honey belong to a "madame". If you were charged with patronizing a prostitute, I think you will be in serious trouble with USCIS. What concerns me and which is something which you should be a little worried about, is whether ICE made notation in your file, also I wonder and if they can pull-it through your SSN, 99% percent that they can find information on your immigration status using your SSN, they are the federal govt. You should hope that they just used it to verify your legal status in the US, and just decided to cut your some slack, you needed some action and understandable for a man to want a woman. The big issue here is also that you don't remember if you were FP and your filed added with notes about your visitation to the "madame" house.

Lastly, each time USCIS hears the word prostitute, their antennas are raised and will luckily want more details, paperwork that the case was never filed. In the absence of knowing which offices raided the prostitution place of employment, it will be hard for you to collect this information. You strategy should be this, talk to a lawyer first, and secondly, ee if you can ran your name against the court records, to see what appears. From my own experience, in Maryland, I can run my name in their court system, it will show that I had a speeding ticket in April 2010, that's it and it list all traffic, criminal and civil (glad I don't have anyone). I am not sure if CA has this info, you want to see what USCIS can find via routine background research. If you are positive that no case was ever filed, then I wouldn't mention this episode because unless you can prove that you were never charged, USCIS will require information outlining that this case is done and never filed.

I didn't judge your morals, did I? I just had fun with the prostitute aspect of it.

BigJoe5,

section 212(a)(2)(D), as far as I understand does not apply to me. I may be wrong..

Al Southner,
Thanks..I guess I am back to my original question in the thread..a lawyer in SF Bay area

I will try and talk to him..Either way should I mention this on the N-400 form or not?? What do you guys think?? The incident took place outside the statutory period of 5 years..as I have been a LPR since Jan, 2002 and incident took place in Oct 2005...

Thanks

In your shoes, I would keep mum about it cause you don't have any information, court disposition or police record indicating no charges were going to be filed. On the other hand, you can casually mention it, because it is outside the statutory period. Talk to Ron and I think he should give you solid advise on it. Also, check on this site as to when Rajiv is going to have a conference call, he is good too.

your lawyer doesn't have to be in the bay area. My lawyer, Bill Schiller, is based in Chicago and I am in SF. You can check AVVO.com. I think it is a good source of info!

Memo,

Thanks..If I may ask, why did you use a lawyer? Most people file the application themselves if there are no issues..

Thanks

e1153e , I just wanted somebody to look at the uestions and prepare the application professionally. i had no issues!

I got my fingerprints checked at California Department of Justine and nothing showed up. Does that mean I was atleast not fingerprinted by local police...

Passed my interview a couple of days back. I did mention in my application about the detention by ICE. Officer asked minimal questions about the incident and made me write on the application that there were no other arrests and citations.

BTW, how long does it take from passing the interview and getting the oath letter..

E congratulations, did get a lawyer? How was your interview experience. Usually as I hear you get your OL within 2 weeks to a month....Did you get recommend for approval letter.

Cjack,

Yes, I got a lawyer. Interview went pretty smoothly and I was recommened for approval and infact my status changed to OATH today

@e1153e

Hello.

Off topic - when was your interview ? Mine was almost 3 weeks ago (May 3rd) in the bay area and I have not heard anything from the USCIS.
