Bank Statements and W2's

We are getting ready to file I 485. Looking at the documents our lawyer requested to prepare the application and what people are sharing here I have a question:

Our lawyer never asked us for any bank statements or w2's. Are these a necessary part of the application?

Can I expect problems down the road because these are not submitted?

I have never heard of this and I don't think I did that for myself.

I have a feeling that your lawyer wants to charge you based on how much you make and have in your bank. Watch out :D

Well, I am the dependent spouse, my husband is the primary applicant. We also have a kid adjusting with us. The package sent by the lawyer contained only G28, G325 and I485 for each of us. No affidavit of support? And no bank statements/w2's requested.

But I am also an H1B, and I have never held dependent status, will this mean that these are not necessary?

* For employment based, no affidavit of support required.
* W2's/Bank/Tax stmts are not required for 485 and many got GC's without them.
* But for some 485's they issue a RFE/at the interview they ask for w2's/tax, to verify that you were in status all along. It all depends on the officer adjudicating your case. For this reason, some lawyers prefer to send it all before hand hoping to not give a chance to the officer to send an RFE/interview.

When I was filing the I-485 a couple years ago, my company's lawyer had bank statements and W-2 and income tax returns on the laundry list of documents. I figured the W-2 and tax returns would help with proving that I have the job I say I have and would erase any doubts that I am making the stated salary, but I challenged them about the need for bank statements and proof of other assets.

They said it is to show that I won't be a public charge (end up homeless or on welfare or something like that). Normally the USCIS requires you to make at least 25% above the poverty line for your household size in order to alleviate their concerns about "public charge", and if you are under or close to that threshold you should provide proof of assets to bolster your appearance of financial stability. I said that my salary by itself is far enough above that limit that I shouldn't need to provide any more proof of my finances.

They agreed and filed the I-485 without the bank or brokerage account statements. There was never an RFE for the bank statements, and my green card was approved last month.

Some lawyers will go as far as asking for salary and bank information of the dependent spouse! And unfortunately some don't question the lawyer, and so they just go along with it.

Okay - since you are employed, you don't need to be sponsored. Is your kid is an U.S. citizen? In that case the same logic will apply and no I-134 is required.
