Bajrang,
Is your ND/RD of I485 01/00 or 01/01. Also can you tell us if your TD is 02/01, why did you get your ID so late. Did you enquire about it to Baltimore or has your PD became current in last couple of months. I am asking this because now-a-days people with TD of April are getting their interview dates.

I am not sure about TD. I assume it\'s the date of I485 transfer notice (to local INS processing center). I think the date is last week of feb 2001. My PD (EB3 India) has been current just in this month that\'s why I got interview notice late.

I never inquired to any INS because I knew the fact that before PD and ND become current 485 can\'t be approve.

I don\'t have the notice right now with me but I am sure it\'s either last week of Feb 01 OR first week of March 01.

even though we never applied for CP , still our I-140’a are approved for CP, depending upon the every ones convenience some people apply for I-485 and some go for CP.

Now the questions is , if our I140 is approved for CP still we went and applied for CP such cases are getting transferred for local offices ,

But I am not clear how much percentage of cases are getting transferred like this , I have bunch of them saying there papers are in abroad they need get from there.

I will check my I140 if it was transfered abroad or not. I did not apply for CP and I filed 485.

I am also in the same boat where my I-140 was approved for CP, but I applied for I-485 and now my case is transferred to Baltimore.
Do you have any idea if we can do anything to get our paperwork from abroad consulate(Bombay in my case) as we have been by experience of EMI and NSK that INS is not retrieving the paperwork by itself.I called NVC and INS -Ask INS(1-800-375-5283) and they told me that it is better if I let Baltimore office know that they have to retrieve the paperwork from Bombay or call Bombay Office and tell them that I intend to file I-485 and not pursue CP.
What are your thoughts?? I was initially planing to send an Email to Baltimore office about it but now I am a bit scared thinking if they would screw it by my Email. Don\'t know whether I should just sit and hope they would do it by themself.

It was my thought that if our I140 was approved for CP then it will get transferred to local office.

In my case and many people I-140 got approved for CP even though we never insisted for it. When ask my lawyer he says we don’t have do any thing, I asked him do we need to write a letter to abroad India to send our papers back to US. For everything he says we don’t have do any thing.

This discussion was going on in foram quite some time , every one says nothing is like that , they don’t send papers physically they will get transfer electronically and if they need they will have in there system. No one knows which is correct . Some time back some one had posted, link from sheela murthy site saying we don’t to do any thing some times randomly they will get transfer to local ins. I had posted a message in imminfo even Ron said the same .

So no one knows what exactly we need to do when our I-140 gets approved for CP . In your case first thing try to call Baltimore and find out when are u going to get the interview. In this case your lawyer should say some thing I know these lawyers are they will involve in straight forward case if we all such questions they never answers properly

The logic of transferring cases to local INS is I guess random and has nothing to do with CP or not. I think they just transfer some of their load to Local INS.
However presence of paperwork at consulate abroad is another issue and I guess quite important after the experience of EMI and NSK. I think NVC transferrs the paperwork( I don\'t know if physical or electronically) to consulate abroad once your I-140 is approved for CP( which I presume is as per your I140 approval notice if it says that it has been forwarded to NVC) and you don\'t inform them within 30 days that you do not intend to pursue CP but file AOS in states only. Now logically as per INS as well as the attorneys, INS should retrieve your paperwork back from abroad once you file I-485. But it seems as per experience of NSK and EMI that they are not doing this. So may be we have to do something to get Baltimore know that they have to retrieve the paperwork or contact Bombay asking them to send it to Baltimore.
I don\'t know what to do. May be I would try contacting my attorney and see what he says.
