Bail from detention

Hi,

Please help!

Last week DHS agents arrested my brother-in-law in Chicago and detained him after serving him with NTA. He entered the US without inspection and his application for adjustment of status was denied late last year.

How can we bail him out?
 
I don't think a bail will be available for him as he is a flight risk and even if it was due to the denial last year he might have a active removal order.

The NTA does put my brother-in-law in removal proceding however he's entitled to file for a green card based on "Cancellation of Removal". He's not a flight risk because he owns a company, a condo, few cars and he's the only caregiver for his gravely-ill USC parents.
 
Cancellation of removal is successful in a IR of a USC case with a I-485 pending, I know a Patel that owned few Motels and was still considered a flight risk and was eventually deported, Goodluck !
 
Why are you asking the forum, ask him. He was served with a form that tells him if he gets bond or not.
 
What date was the NTA sent to him, or am I to understand that DHS agents carried the NTA with them and served him in person while arresting him him simultaneously in order to detain him without bond due to the high flight risk?
 
You Sir are a idiot. DHS Agents are the good guys, you seem to forget that everyone they deal with is guilty of something. You might think that the crimes are a big deal, but that isn't your problem. NTA's are issued after the gathering of facts, and with-in 48 hours of arrest. Even if a ICE agent gives someone "no bond" a DOJ Immigration Judge can lower, raise or keep the same. At the time of the serving of the NTA, he should have been told his bond amount, assuming he was in ICE, otherwise it isn't required.

Get a good attorney who knows the court system. Best advice is contact the lawyers in the local AILA chapter or ck ratings on avvo.com and if you can get a certified immigration lawyer that would be the best. He has a shot at bond, as long as he is not a criminal or flight risk. You should also gather all his docs that include letter from physician regarding the parents, their passport copies, copy of his auto and home mortgage etc.. Bring his passport to the bond hearing and surrender it to ICE. Perhaps even get a letter from a local community leader. keep us informed.

Is there actually a point to this long babble? I'm merely asking him exactly how his brother ended up detained with bail. It's a question that I want the details about. What "crimes" do I think are "a big deal"? You really make no sense you sound like your imagination is running wild.
