bad news for EB3 indians

The state deparment web site says that the priority dates moving forward is going to be limted. That means for this whole fiscal year the prority date for EB3 indians will move may be to Nov 98 and by then they will run out of all the visas for this year. Then in Oct 2006 the same cycle will start, in other words someone with a prority date of Jan 2002 will get approved in 3 - 4 years from now if they have already filed 485, in the meantime they will have to spend $175 every year per head per renewal of AP and EAD. The ones that haven't filed will not be able to file for another 4 years and thus will have no EADs for their spouses or no AP to travel. So going out of the country will be very risky for them, the only good news is that they will be able to file H1B 6th year 7th year .. extentions so that they can work.
USCIS should at least provide EADs and APs without any expiration dates or valid for 5 years.

Actually it does not mean that filers having PD (EB3 retrogressed country) later than cut off date will not get approved.
Cut off dates provide USCIS
a firm answer for many callers who call them very often and
a policy to work on

There are very few pending cases of 98/99.
It is going to follow same pattern we had earlier. To back up my answer I have some links for EB3 INDIA. (Patren is same for other retrogressed countries)
See below bulletins and observe the jump it took every month.

That's good to know. But "pattern" is established based on atleast two different time periods of same situation. Mar 2001 - Jul 2001 is the first time period when this similar situation occurred.

Item D in the Visa Bulletin (number 85) announcing the September cut-off dates provided information regarding the prospects of visa availability during the early months of FY-2006. Many categories have become oversubscribed for October, and cut-off dates established due to continued heavy demand for numbers by CIS for adjustment of status cases. Forward movement of the cut-off dates in these categories is likely to be limited.
