Backlog in I140

Unattended cases lead to backlogs and more problems...(for us as well as them).
Why don't we also suggest that if someone has applied for I-140 and I-485 together and they have been pending for one year and the applicant has completed more than 3 years in one company that either
a) Use the AC-21 in case he/she is laid off while awaiting approval of both
b) USCIS put these cases in a separate category and adjudicate the cases within 30 days? (Of course if an application is fradulent or there is a criminal case against the applicant, they can reject it outright. If they need more proof they can send a query and once they receive the answer they can adjudicate within 2 weeks)
Rajiv does this seem fair?
 
I agree with askgc that we should address this issue directly with Mr Prakash.Khatri. We'd be denied by INS by the time those congressmen make any move.

setuptofail, I think it only complicates things to suggest alternatives at this point. We should focus on
1) making pending 140 / 180 day 485 cases eligible for AC21.
2) unfairness of speedy pilot program at the expense of earlier filers.

Very simple and we have very strong arguments on both points. Otherwise INS will ask why you think it should be one year not one and half year?

I will post more possible actions to take in a couple days.
Each of us should also ask at least *ten* of our friends, famlies to email, fax, mail to Mr Prakash.Khatri.

Let's make it happen!
 
count me -I-140 Jan 2004- CSC from CA.
What happens if there are problems in I-140, my HI-B 6-years expires in Feb 2005?
Should I hang on with this employer, or dump this employer b4 employer dumps me...

looks like these suckers are working on everything except CSC 140.
LC backlog reduction program is in place ( after we wasted 2.5 yrs for LC)
485 pilot program is in place for new files ( filing after april 2004)
140 are getting approved pretty fast in NSC/VSC.
485 processing is at its fastest speed in TSC.

It's like my bad luck reaches the destination before I reach there :confused:
 
Allow AC21 if I140 is pending more than 6 months

I think we should focus on the following points;

1. Unfairness: New applications are approved while old ones are still pending.

2. Efficiency: I-140 processing are on the standstill especially EB2 processing date hasn't moved a day for a year. Lots of cases are pending for more than 365 days.

3. Legal issue: For concurrent filers, useage of AC21 becomes totally invalid. For non-concurrent filers who can't have EAD card to work, maintaining H1-B status is crucil. Lots of applicats' H1-B have met the 6 years limits and renew it every year is not cost-effective(it costs H1-B holder's time and money and increase CIS's workload.)

I didn't get your PM. I'm sorry to hear your case has been pending that long. Did you get RFE or did you fax inquiry to CSC? Even the current processing date hasn't moved but yours is the way ahead of that stupid 7/18/03 date. You truely deserve a fair answer from CSC.

I called USCIS 800 number to get the case status. It says same status as seen online. Then automated voice system suggest to press "9" to transfer to customer service. I pressed 9 and it says your wait time is more than 30 mins, so call back another time and best time to reach is wed/thu/friday 8am-6 pm. Well, I called wedenesday at 1:30 PM ....as they suggest and still forced to hear their "GOOD BYE" message...
Does anyone really know what time/day is best to talk to someone there?

this is definitely good news...at last they moved . I hope this is truly 7/23 and not fake like in 485..where they keep moving every month..even though lots of feb, march 2002 cases still pending.

This is really good news..finally.
I think those approvals for 04..must be part of pilot program.
 
Wow, this is really a great news. Look like they started moving their asses. Are they clearing only non-concurrent applications or both?
But still if they process at this speed, I will be getting it around age 133 year and 36 days. :(
 
This stats shows quite a few approvals for September cases. That probably should make us
optimistic. Le's hope ...

I think All of us should seriously take actions NOW NOW to fight with INS. It has been a long time people talking around, but I really want to pull the effort together!!

140 Status has chaged again

Your I140 IMMIGRANT PETITION FOR ALIEN WORKER was received on February 9, 2004. We mailed you a receipt with information about processing. It is taking between 360 and 360 days for us to process this kind of case. We will mail you a decision as soon as processing is complete.

It was about 400 days, then changed to 240 to 300 days today it has
changed again back to 300-360 days
Look like they have some random number generation software installed :))
