Backlog Elimination clarification please!

Hi,

With the new back elimination and national processing procedure:

1) Does this mean, instead of having many SEAS's across the country, each receiving and processing LC applications (granted, some much slower than the others), all cases not opened by 12/31/04 will be forwarded to one of the BEC's? And given that it's pretty much the end of the year and they're literally boxing up the cases, we can expect no progress whatsoever for a few months?

2) If a case that was filed in, say, July 2002 and the SEAS processing date is May 2002, does this mean the case, instead of getting processing in a couple of months, will get in line with all the other cases in the BEC and probably won't processed for a year? How is that "backlog reduction"?

3) If I submit a LC application now, and the case is not opened by the end of the year, does it mean it'll be forward to one of the BEC's, not one of the NPC's, and line up at the very end of the long backlog?

4) If I wait until early next 2005 and file my LC application, does it mean it won't have to line up behind the backlog cases at the BEC and will be forwarded to one of the NPC's which will be processing only the new cases and should therefore be much faster? What address do we send the application to directly?

5) If PERM is not implemented in early 2005, will Atlanta and Chicago act as BECs ore NPCs? In other words, will they process new cases or backlog cases?

6) If PERM is implemented, is PERM the ONLY option to file new LC? If not, will new regular/RIR cases be processed by the BECs or the NPCs?

From what I understand from the memo.

All "un-opened" cases in SWAs will go to NPC

All "opened" cases and Regional DOL cases goes to BEC.

SWAs will not "open" cases after Jan 1st 2005 irrespective of PERM status.

Yes. after PERM that is the only way to apply for LC.

1. Yes u r right. As per memo initially reginal BL cases will be sent to BEC. After 12-31-04, SWA starts sending all un opened cases to BEC. DOL-ETA expects to complete this process (boxing, shipping, logistics etc) to be complted by SWA by 03-31-05. Yes it is very much possible that this change will affect the processing speed of SWA apart from holidays.

2. This examples case is will be better shape in BEC. As the PD july 2002, it will be processed first as per "FIFO" priciple. My RIR case will be in worst shape. It was filed in May 2004. If this memo is not issued, there is a very much possibility that my case will be opened in Jan or Feb 2005 by SWA and it will be sent to Regional DOL in FEB. My regional DOL always "current". Hence My LC may get approved in FEB/MAR 2005. Because of this memo, if my case goes to BEC, it will stand in end of the pipeline (As my PD is May 2004) and it is going to get "backloged" in BEC. I dont know howlong it take to clear the backlogs. It totaly changed my LC scerorio. Instead of getting approved LC in 2 or 3 months now, I have to wait for 2 years. What a great backlog elemination policy by DOL?

The best approach for you to do is, if this new policy ever gets implemented, you can ask you sponsoring co to withdraw your case or let it sit there, it really doesn't matter, and ask them to file new LC from one of the NPC. But even so, all you can see is your LC, I140, EAD and AP seems to go faster, but you get stuck on filing your I485. At least you will have your LC cleared faster and you have benifit of getting all others clear instead of waiting on line for aniticipated 2 years.

1) SWA will send the "unopen" cases to NPC.
 
Mr read of the situation

From what I understand, it appears that if the case is already filed and the SWA has opened it and has not completed processing by 12/31 - they are required to complete the processing and then forward it to the NPC. This is not a bad deal.

If they have not opened it - it goes directly to NPC (may be OK - but NPC will now direct the recruitment efforts and such - no one knows how that will turn out) - so this is a less than ideal option (more due the unknowm devil factor).
 
I understand that we are not sure about how NPC would do central processing (recruitment etc.) But, wouldn't it be hopefully faster than two step processing? Which is why they are making all these changes in the first place. I think un-opened cases going directly to NPC is not such a bad deal after all, compared to waiting at SWA.

If you go over the memo again, I am sure you'll find it the other way!

All unopened cases from SWAs will go to BEC and not NPC.

NPC will accept only new cases filed after Jan 1st 2005.
 
What will happen the cases which have been processed by the SWA and forwarded to regional office for final decision?

Will those cases been processed by the regional office or BEC or NPC ?

My case is waiting in Chicago regional office.

Please clarify.
