If this is what is happening ,then I think we have to drag BCIS to court. I was not aware of this situation. I will support this cause and do whatever I can to the best of my abilities

"I guess, the 'normal time' should be the one stated on the RD. It's like a contract where they agree to process your I-485 in the number of days stated. If down the road, there are changes in policy or priority, they should send us a letter notifying the delay.
The least they can do is post a public announcement on their web site"


One of the members wrote that paragraph above: well what can I say: My 140 Receipt said: no more that 180 days but it's been about 500 days. Is it reasonable? Is it a contract? I don't think so. Thank God it got approved but this is definetely beyond reasonable. I didn't check what my 485 receipt says... class action suit is the way to go.
 
even our I-140 approval took around 18 months but we had no option other than to wiat....our lawyer said that the ins had lost the reciept:mad:
 
Instead of discussing for so long somebody can send a message or e-mail to Shusteman and get his opinion about Law Suit. If he thinks this is a valid case for Law suit then proceed from there.

It was not one of prolonged useless discussion. We already initiated talks with Attorney Rajiv and he is also exploring the possibility of getting class action for such law suits.

America is all about money. Active immigrants like you need to arrange class action lawsuit. This could be done with money contrubution from
all people who waits for I-140 and I-485 approval.
Bloodsucking industry of leeches created themselves.
Now they will support themself.

Going with petitions is a waist of time.

I believe many immigrants (pending and maybe even who got green card) would be willing to pay to crush this bloodsucking,
nervesucking, moneysucking, life-breaking, family breaking,
health breaking, leech supporting machine.

Result of lawsuit must be at least acceptance of US BCIS
nominal sum of money per petitioner for premium processing (they must justify how much money per case they need to go under 1 year/6 month /4 moth /3 month etc.)

Otherwise they can easily say- we agree it is unreasonable
for people to wait so much but..
but that is how much resources we have.
Immigrant must force them (through class action lawsuit) to give out numbers to
remove resource question, negotiate resource/money
and force them to accept conditions and follow conditions.
(And immigration lawyers certainly will support this situation.
I do not want to lump every lawyer into one- but all lawyers
are human who has relative, kids in college etc.-Amerika
all about money- and money (not only terrorism) contributed to
this situation.)


We immigrants need to save ourselves, we need
laywer firm who may say to us:
As soon as "jackpot" hit so many $M USD of contribution
we exclusively starting lawsuit. We have all regalias/conncetions
in DC for this let's go.
money start pouring as soon as this will be explained.

Certainly class action suit must force BCIS to accept
few points that you wrote in petition letter to alleviate sufferings.

Petition is just stepping stone. Rajiv is in the process of incorporating a non-profit organization for us, then we can collect funds for all our activities.

Most of us would like to move ahead with legal action against USCIS. So, obviously we'll move ahead in this direction.

But personally I believe that Congressional campaign is not waste. It is a slow process but ultimately we'll succeed.

We can get desired result from judicial branch if there is law, if there no law we have to take legislative branch path. AC21 is very good example.

There are different kind of applicants.

But anyway, I would like to see immigrant voting with
money for faster adjudication of their cases.

I bet people would give $100 easily per each 1/2 year saved.

Cause is bigger anyway. It is not only you who suffer
if this continue, later immigrant will suffer too.

Rajiv has requested qutoes from few people, so let's wait for his reply.

I like this "$100 for each 6 month saved" philosophy.
 
Better would be to contribute

$100 per month till once gets GC. The start date for this $100 monthly deduction should not be later than 2 months of start of contribution/ filing of GC.
How does that sound ?
