Background Check Pending /2nd FP Notice ?

Hi Gurus - Here is my Background info.

a)Applied AOS - I-485 , I-130 on 10/31/03 (Marriage -USC)

b)Interview - 08-June-04 - Could not stamp my passport because background Check was pending

c)Applied and recieved EAD by Oct-04 (Efile)

d)Infopass Appt 01-FEB-05 to check on I-1485 status -
They said my case is waiting on Additonal Security Check

e)Applied AP and Recieved by Jun-04 (Efile)

f) Applied for EAD renewal Jul-04(Efile)

g) Called NSC 800 number to check on case Status 04-AUG-05

h) Got a reply from USCIS on 18-AUG-05 that my case is waiting on FBI fingerprinting ( as they have expired) with an Appointment to go to the Biometric processing centre ,There was no mention of pending Background Check or something

My Question is can I assume my Background Check is complete ? or they need to re-process my fingerprint to move on to my background check again ..I would really appreciate if someone can shed some light on this

FP expires every 15 months.

In my opinion can means both things. Did you call again and ask if they are doing still your background check (name check with FP)? Can you give us your country of origin?

Thanks for your opinion , well when I went to LA Local office on 01-Feb-05 , just over 15 Months from the day of filing & they told me that they are waiting on additional security checks . But I guess its 15 month from the day your last finger prints were done .....FBI sent name check / Fingerprint results on 23-DEC-03 to USCIS , maybe that the reason they asked me to do it again ....my country of origin is India ...can you please tell me how is that relevant ?

Also when I did phone Inquiry ..they sent a letter stating that my application is pending this process to complete ...and enclosed was a appointment for Fingerprinting stating it's expired

Its just wishful thinking on my part rather than rational ..

Well apparently in some issues like the country origin is relevant for the Name check thing...if you check out the thread about it. But I think is just luck or if your name is pretty common.

Is not strange about your FP taking again. It is 15 months every time you take your FP, it is from the time they take the last ones. FP really don't expired (physiologically talking) BUT don't ask me why, are their rules. Won't be from the time you filing duhh...you don't file your FP :)

Well reading again both of your posts that then can means that your background check as name check it is over which is the longer one, but since your FP are expired they need to take those again to check it out. Normally the part of approval on FP are within 48 hours.

Do you have to make the appointment or they will send you an appointment letter?

Well Im hoping thats the case . Yes they sent me an appointment to go to ASC ...from what you are saying it sounds like FP processing is pretty quick...my guess is ..all they need to do is run the FP check against some database ...

Yeap! the FBI use different databases, for run just FP is pretty quick. Plus LA is conducting the cases very fast.
