background check black hole

Well its official :rolleyes: that my I485 case (with PD and RD 9/05) is stuck in the background/name check black hole. Following is what I received upon enquiry with USCIS. Their efficiency in giving me this news was amazing!!! ... about half a day after the enquiry I got this email. They haven't yet responded to my spouse's I485 case status enquiry. Her name is much uncommon unlike mine which is extremely common. But I guess her case will not get approved until mine is approved.

Any suggestion guys?? I guess I will have to do all the enquiry stuff.. congressmen, senator, fbi etc etc... which some say is useless.....

eb1doc and others did any of these enquiries help in your cases?

looking at this forum it seems that most lucky Indians are stuck in this process for atleast two years and the unlucky Indians are stuck for more. Has there been an exceptions for Indian born (like for the lucky firstworld born) to get I485 approved within a year???

grrrr I guess this is going to be a painful wait!!! but then who am I to complain .. my I485 has been pending for only one year and my EB1I140 has only been approved two months ago.... :rolleyes:

still I would appreciate your comments...

Sorry to hear this. However, I know two Indians who got there GC in 3-6 months, one with EB1A (VSC) and other with EB1B (CSC). ofcourse all this happened before centralization to NSC! Come to think of it, their names are extremely uncommon! and strange that I know another person who applied at the same time but still waiting on I-485...with a very common name. I do not know whether the name playes any role, I'm concerned as there are many guys with my name (although i'm still waiting for I-140 decision)!

Somehow I am more or less convinced that the background check is proportial to the commonality of your name or may be proportional to the square of the commonality of your name. I think other than your name and birth date, they don't look at anything. I doub't they use SSN. Ofcourse all this only applies to Indians and similar.

Is there anything they check with Indian government also (information sharing of criminal records) so that it may not always computerized to check fast?

How do yo make the enquiry, through phone or email?
Did you talk to NSC representative directly or just National Service center?

This was a pretty standard enquiry. Just follow the instructions when you call the 1-800 number. If your case is outside the processing time (based on USCIS website) the customer service rep will file an enquiry for you. I doubt this enquiry has any use.

I did not talk to any NSC rep.

Sorry to hear about it. I am also stuck in this process for exactly same time as yours. I feel its becoming more common now. I did not come across a lot of cases before last year. People do lot of things like fbi, senator, congressman. but i believe none of this helps. I have done some of it but now i have given up and just waiting.

quite a standard BC reply.
ur wife's answer will come same but by mail.
i know many people who got this answer.
I will be positive
and surely be positive based on my experience that senators enquiry ..read speed up request do help.
BTW could you pl tell me ur dates?
i am sorry if you have posted it already.....

I140/I485/EAD/AP RD 9/30/05
EAD/AP AD 11/05
FP (Photo and FP) 2/06
I140 RFE 4/06
I140 AD 8/13/06

I485 has no LUDS after FP and "out of processing time" enquiry on 9/30/06 revealed stuck in background check and wait for six months.

what should be the gist of such requests. I know what info to provide such as LIN#, A# etc.. but what should bethe request?

Well now that you got the response and you are current.
you shoul dnot go for senator help for further enquiry
your enquiry will surely help to speed up the process
however, you can request senator to request BCIS to speed your name check process.............your dates are are in good range to ask for that...
