Back as Permanent Resident!

Hey fellas,
This is a follow-up to my post on my interview experience at Chennai. POE was at Minneapolis....hardly exciting.....saw scores of people waiting for their immigration check at the "Visitors" queue. I went straight to "New Permanent Residents" line where there was hardly a soul waiting except me. No questions asked. The immigration officer took fingerprints of my index finger and asked me to sign an I 551 form at a couple of places, and she finally stamped my passport endorsing the immigrant visa stamp provided to me at Chennai consulate and thats it! She said it would take about 6 months to receive the plastic card (!) which cannot be any further from the truth. Back in the US as a permanent resident. It's a great feeling and kinda hard to believe everything's over so soon:) (my priority date was Aug. 17 2004 and interview date was aug 17, 2005!).
Again, my sincere thanks to all the wonderful posts on this forum and the experts behind them. GS28, hope you have a smooth experience at the POE. Call me when u get back!
 
Hi all,

Me and my wife had our Interviews today at Houston office. Everything went on well. Officer checked my H1B documents and asked regular questions about arrest and stuff and made us sign and finger print on I-551 form and took mine and my wife's I-94s and said we are all set and we can go now and went out of the office before we could ask him anything.

any comments are welcome.

koolgui -- were you talking about a POE experience after getting an immigrant visa stamp after CP? Or .... ? Do clarify. Sounds like you've got an I-551 in hand, so that calls for congratulations!

I'm talking about my I-485 Interview at houston local office. I haven't got my passport stamped. I wanted to know the procedure and the timeframe for the pp stamp as I do not have my I-94 with me and if I have to travel how could that be possible? any suggestions or coments are welcome.

AC-140 for Spouse & Son- Packet 3 docs sent to Chennai consulate

Hi Friends,
I got my GC approved in March'05 undrer EB2 with AOS and not included Wife and Son during that time since they were in India (Son born in India). Applied I-824 on April'05 and after getting receipt on last week of April asked my attorney to process AC-140 in Chennai Consulate. Attorney requested for the process on end of May'05 and he received the e-mail from the chennai consulate on July 10th requesting All Packet 3 documents to process further. We sent 2 sets of all requested documents to consulate on August 9th.
DS-230 Part 1 for both, Birth certificate, Marrige Certificate, Passport Zerox and GC card all notarized.
My question here is we have not received any case numbrer from consulate so far for this process.I am very confusing here, Normally when can we expect case number and interview dates.. People are telling once we request the AC-140 process if accepted they immd assign case number.
appreciate any help or clarifications / suggestions .

I had asked Chennai IV unit about AC 140 quite a while ago and this was their reply. Hope this helps:

On a case-by-case basis, the U.S. Consulate General in Chennai accepts employment-based immigrant visa cases for processing when all the following conditions are met:

· USCIS has already approved an E1 or E2 category immigrant visa petition

· The applicant has an original I-797 form

· The applicant is a resident of the Chennai consular district and the priority date of the case is current or could reasonably be expected to be current within 60 days (we will not warehouse non-current cases).

· Waiting for the USCIS to process the change-of-status application would cause the applicant hardship

· The applicant has attorney-certified copies of all pages that made up the original immigrant visa petition

· There does not appear to be any indication that the case is fraudulent

· And our workload permits us to take the case

If you believe that your case meets these conditions, have your attorney send certified copies of your I-140 paperwork to the Immigrant Visa Unit, U.S. Consulate General, 220 Anna Salai, Chennai 600 006 India with

· The original I-797 Notice of Approval Form

· Complete forms OF-169 and OF-230, part 1

· An e-mail address where we can contact the attorney with confirmation that we have accepted the case

DO NOT send any submissions to any officer or employee by name. Doing so mixes business with personal mail and results in lost paperwork when officers transfer.

We are accepting E3 cases that meet the above conditions on a more limited basis, where it is clear that the applicant is highly skilled. We would accord precedence to applicants who have already received H1-B visas in the same profession or for the same employer.

NOTE: This procedure only applies in change-of-status cases. If USCIS has approved an employment-based petition and you had asked from the beginning to apply for the visa in Chennai, then we must wait for the case to arrive from the National Visa Center.
The process of review by the officer to decide whether or not to accept the case will take around 4 to 5 months.

Hmm -- I'm cluless, I'm afraid. I was CP all the way. I might suggest posting this question in the 485 forum .... I'm sure people would know. It seems a little strange that he took the I-94 but didn't stamp the passport, but then, I'm not familiar with this procedure.

Our attorney submitted AC-140 Paper work to chennai consulate and they responded and asked to send Packet3 doc's for my wife and son. Attorney sent Packet3 docs to chennai consulate on August 8th and we have not received anything back like case no...etc...
Any idea some one can clarify me please what would be the next step....
