B2 visa holder in USA, wish to apply for family immigrant visa : Help

Hi

I am a B2 visa holder, currently living in the US. I will leave US shortly. My sister is a US citizen. She likes to apply for me under family immigration category. My B2 visa is valid till 2018. Can she file a immigrant visa petition for me? If she applies for me, will it create any problem for me to enter into USA in future?


I don't like to apply for adjustment of status in the US. Rather I will go back to Bangladesh and live and do my job there. The fact is for a sister applying for brother it needs at least a decade. Within the period I like to visit US with B2 visa.

Any one experienced here to reply me?

Maybe. But if you can demonstrate strong ties to your home country, and it is not close to the time when your priority date becomes current, then it should be okay.

Assuming you hold a Bangladeshi passport, you will be, more likely than not, denied entry as a visitor after your sister sponsors you.
