Hi everyone,

I would like to ask your help in a specific situation. My brother got accepted in a university in USA. My mother lives with my brother and i am a graduate student with F1 visa. I would like to know:

1. What type of visa my mother can have if my brother is coming for graduate studies (F1 visa).

2. She has already been here for couple of times visiting me, is it a good idea for her to go to embassy before my brother applies for F1 visa?

3. In this special case, would the consulate give B2 visa for a long time since both of her sons are studying at USA?

I will hope someone can answer my questions and give suggestion if any...

thank you very much

Your mother may not live in the US. If it is essential that she have one of you with her, your brother should delay his education until you return to your home country.

B2 is her only option. She should be able to get it.

Don't mind people's useless comments in this board. They forget that we are here to share information, and not life lessons, right Concerned4us?

tschang,

We are here to share advice but only what is legal in the US. OP's mother may not use a B2 visa to live in the US. That is against US law plain and simple. If you and the OP and anyone else has determined that they are so special that they do not need to abided by US law and will announce so on a public forum then I will most certainly tell them that they should not come to the US until they are willing to do so.

Do not suggest that violating US law is acceptable; it is not.

Hey guys,
I am not sure why border9999 mother have to go again and again to get her visa (which is B2 i guess) to visit him/her. The only scenario I can think off is that she is getting 1yr visa every time and in that case yes she would qualify for only B2 visa again. But the brothers situation is different. Technically it could hurt his chance of getting the F1 visa if the mother is standing in line just before hi. And on the other hand it might not hurt his F1 chances but hurt the mothers chances of getting another B2 visa.

In my friends family all the siblings came over to US one after the other on F1 visa and the parents got their 10yr multiple entry visa. So they just board the plane and come to US where they stay for exactly 6months every time. They have done that several times with no hassles.

However in case of individuals who are not from India the mother could qualify for a lottery to come and live in the US irrespective of the childrens status here (I am not 100% sure but I think I am right. Please double check).
And in some strange cases I have heard of parents coming over on a B2 visa and change their status to either H1 or GC with legal help. So it is possible to extend the stay but it will have to go back on your word to return to home country. I am very confused about the legality of it (its only my evaluation and not even opinion). I am very certain only a attorney can advice you on this.
Hence I think after the brothers F1, the mother could get her B2 and look look in to the legal procedure to stay longer through a good attorney.
Good luck
