Okay, we'd like to get my husband's dad and brother to visit the U.S. over Christmas and New Year's. Dad is retired and brother is 16, and there are a lot of ties to Mexico--his dad is married and his wife wouldn't be coming, still has other minor children as well as other kids there. My brother in law is also interested in looking at universities while he is here, because he is considering applying for a student visa when he graduates H.S.
Here's the problem. My husband is undocumented (we have an I-130 filed for him at the moment, but it has only been filed for a couple of months), and he has three other siblings who are here in undocumented status. None of them entered on a visa, but if it makes any difference my husband has been here since he was a kid, so it wasn't an intentional violation on his part. Would this have an effect on his dad & BIL's eligibility to visit as tourists?
They would be staying with us and other siblings if they could come, and we would pay for their visa application fees/tickets/etc and any other expenses while they were here. Is it possible for us both to sponsor them if they are at all eligible? If not, am I able to sponsor them as a daughter/sister in law by myself?
I've read that it does not help if you sponsor someone and often makes it worse, but we would be paying for everything because they don't have the money for it. Would it be better if we just sent them a couple thousand dollars or something? How much money should you have to prove that you can handle the expense of traveling to the U.S.?
Would it be better if they applied just for the reason of my brother in law visiting universities, and not with the reason of visiting family?
Also, my father in law has been denied a B2 visa in the past and my husband said it was because he had family here.
So...what are the chances? Is this possible? I've been reading immihelp.com, but if you know of any other sites that could help answer these questions, please post.
