B2 Visa - Adjustement of Status

Hi,

My In-laws have an interview appointment scheduled sometime in December to visit us and our I-485 is still pending.

What should be the response for the question with regard to our current visa status? Can someone let me know if anybody had been in a similar situation and I am wondering if "Adjustment of Status" would suffice? Does the Adjustment of Status impact them getting a B2 Visa?

no, but other factors might be an issue
if you are not using EAD for work, and still on H1 and using that status then your status will be H1

Hi

There may well be a problem with the B visa for your parents

They need to show strong family ties to their home country, strong economical ties and strong social ties

Section 214 of the INA states

#every applicant shall be deemed an immigrant until such times the applicant proves to the consular officers satisfaction they are not #


As you are in AOS, this could well raise a red flag on their case

I do hope not, but my son was denied for that reason

Thanks Sue. However, my other brother is in India now and my parents are also on treatment for medical conditions. So, I am wondering if a letter from their doctor would perhaps help?
