B2 to H1 to GC

Hi folks,

My sister-in-law is in U.S. with B2 visa and found employer to sponsor for working visa.

If she gets working visa approved and later on applies for GC, will USCIS allow previous change of status and approves GC or will this be regarded as "visa fraud"?
