B2, K1 or K3?

Hello...

I have a question regarding a dilemma facing me and my fiance. I am American, and he is a British citizen living in Scotland. We are planning our wedding for March 17, 2006 in New York and we are unsure of which visa to go with...Both of us are simply looking for the quickest way to be together...

The K1 would be the simplest...however, I cannot file any petitions as of yet because I am waiting to receive my final divorce decree from the courts from a previous marriage...sounds sordid, but it's a long story. ( My attorney tells me I shall have them by the end of December at the latest), and given the time frame, Janauary to March- I wonder if we will be approved in that time frame...I know it takes at least 12-14 weeks for it all to be completed and approved.

I was wondering if perhaps it would be better to have him come here on a B2 after I receive my divorce papers, and simply get married within weeks of his arrival. I have read a vast amount of information on the K3 visa, but it seems the information is geared toward marriages that take place overseas, rather than in America...

Does anyone know if this is a legal option? What are the laws surrounding marriages between a US citizen and British national that take place on American soil?
Can they ask him to leave ? Can the B2 change to a K3?

Any information would be helpful.
