Hie,
I applied for an extention of my B2 in Early Nov. 2006 at Tx centre and My i 94 was expiring in late dec. 2006.
Despite more than 4 months, my extention case is still pending and i have been selected at a hospital on H1B and they are filing it for me... now the question is that can i get the H1 B inspite of my pending B2 Case and 2ndly can any one give me an idea as to how m uch time the extention case processing is completed( they are processing the cases received on dec 15 , 2006 as per USCIS web site 2-3 weeks back)

i will highly appreciate if any one can clarify this to me
Thanks.
Casper

Your B-2 extension application is independent of a possible H-1B. I believe the H-1B quota is full for this year. April 2008 is the earliest a potential employer can sponsor you, unless it is a non-profit organisation.

Dear Triple Citizen,
My H1 b is filed by premium processing by a Hospital and is not under the cap... can some one please claer me if i will be issued my H1 B despite my B2 Ext pending... Looking forward to hear from forum.. Thanks a bunch

If that is the case, I don't see a reason that your H-1B should denied solely on the fact that you have also applied for a B-2 extension.

Thanks Triple Citizen,

So what i infer is that H1 B will be issued despite B2 Pending...Please correct me if i am wrong.

2ndly, if H1 b will be issued, what will happen to my B2 Extention case... will it automatically be cleared or i have to wait for its clearance... thanks a lot for your kind reply..

If you qualify otherwise for an H-1B, it should be issued. Your pending B-2 extension should (and I say should again) not have any bearing on it. If you successfully COS to H-1B, your B-2 extention application will be null and void. However don't be surprised if a decision still makes its way to you. I was once issued an EAD a few months after I got my GC. :)
