B2 Extension letter

Hi

My mother in law has a 10 yr multiple entry visa and her current I94 is valid until October 07 (she came here in May). We want to extend her for another 6 months. Key reason is we had a baby in May and the baby has a medical condition so we need help for some more time.

Questions -

1. what is the right time to apply for an extension

2. what reasons should we quote (can we say we need help at home because of the baby's condition - we have enough documentation from the hospital etc)

3. The air ticket is valid for 1 year, but the current flight date is Aug 25th. What needs to be mentioned in the extension request letter.

4. Does anyone have a sample letter that you can send to me..

Sorry to hear that your baby has a medical condition. But I would caution you to not use this reason to apply for extension due to the following reasons.
1. USCIS DOES NOT LIKE b-2 visitors helping in the household / baby-sitting etc.
2. Secondly the Baby's parents (You and Your wife) are there to take care of the baby. Inspite of this if you still need help in the household, USCIS would expect you to hire a maid or baby sitter to help out, though i agree 100% it is NOT the same as your MIL helping you out.

Last and foremost you need to understand that there is an underlying risk by applying for an extension. If the person application gets denied and if he/she stayed past the original I-94 date, rule 222(g) would apply and could potentially void the B-2 visa. Her next visit would depend upon the officer at the POE.

If you still decide to go for an extension, I would suggest that you talk to a good immigration attorney, and go by their advice.

Think very hard before you file for an extension. A failed extension has the potential to make future entries difficult. Worst case, an over eager POE officer may even consider the multiple entry visa null and void.
