B1 versus H4

My husband has a B1 visa to enter US. However he also has the option to come over as my dependent on a H4 visa. Which of the two is safer? If he finds a H1B sponsor while he is here will it be a problem for him to take up the job offer if he is on B1? Essentially we have to choose between coming over to the US on B1 versus H4 status. Please advise what to choose. Thanks. Rekha

Simple, H-4 over B-1. Two reasons. Firstly H-4 status allows dual intent, B-1 does not. Secondly, he will get an I-94 with much longer validity on an H-4 than he will get on a B-1. In both cases, he will need a COS if he finds an H-1B sponsor.
