Hi
I am actually working here with a company on a B1. Now another company has proccesed and got me a H1. To transfer to the new company should I leave US and get the new H1 visa stamped in india and return before i start working for the new company?
It is a very urgent situation. Someone please help me out. Thanx in advance

Nope! Go ahead and switch to the new company. If and ONLY if you leave the US, then you\'ll need to visit your local consulate/embassy and get the H1 stamped on your passport.

There is no legal reasons why you cannot begin work immediately after your H1 status has been approved, although there may be "intent" against your B1 (but nothing can be proven or used against you in the future).

The ethical thing would be to return back to India with your original company, apply for your H1 visa, close out all your matter with the original company (including getting a letter of completion of employment) and return to the US on the H1 visa.

But the choice is yours
