B1/B2 to GC application via FB4

Hi all
Relative is visiting us on tourist visa. His own brother is a US citizen. Since he is already here (although on a non-immigrant visa), he is wondering whether he can apply for GC via Family-based FB4 category?

a. If yes, is there any advantages like staying here for some more time?

b. Also, whether this person can re-enter US, without a visitor's visa in the near future, while the application is being processed?

(A) FB4 based GC's take 12-15 years to become current. Your relative cannot wait it out in the US on a visitor visa.
(B) Your relative cannot re-visit the US without a visit. With an I-130 in process, obtaining and using a B-2 visa will in itself be a challenge.
