B1 application denial incident -- Help Buddies !!!!

B1 Rejected - 214b

Hi ,


I need your advise on a specific incident that happened when I went
for B1 interview in the Mumbai consulate.

The officer asked me if I had ever visited in US. I said yes. The officer looked
at two H1B stamps on my passport and exclaimed "You have changed 4 companies
in 4 years". "where is this company X", I said "in the US". I said " I went through
x, then joined a startup, Y which went bust during dotcom times, then
i worked at Z for close to 3 years."

The officer stared at me and was typing something. Then I forwarded the invitation letter
given by the CTO. She asked me what are you going for. I said I am going for product
briefing and meet the CTO. Then she said are you doing the same thing as you were doing in the US. I said yes I am in the field that is software field the only difference is I am a Team Lead
managing a Team. Then she asked me how long are you with current company I said
"3 months". The officer then said "Sorry sir you do not qualify for a b1 as I see a pattern in the
way you have changed jobs, you are a potential immigrant. You are rejected under 214b."

I have reapplied and have a date of 21 Sept. I know I failed in showing that the purpose of my
visit was purely business. Secondly, I didnt answer the question related to changing multiple
companies correctly. I request you to advise me what precautions , I should take and what
could be the correct answer to convince that I am not a potential immigrant in terms of the case that I changed multiple jobs.

Is it ok to mention that my wife carrying and due in Dec ? Would that
be a good reason secondly. Would taking my wife along make any
difference for the interview.

Would this have an impact on my H1b.

Any help would be highly appreciated.

difference for the interview. If she is also coming for B, good reason for rejection. Otherwise better not totake her

Counsel suspects, 3 months is too short to go for US deputation. Logically he/she is wrong, because if you want to immigrate you can always opt for another H1 and go. Take a strong letter from present CEo about your assignments.

Thanks Great Guru. I think you have a different understanding on
a couple of points.
I joined this company just 3 months back and I do not intend
to go for 3 months.
My wife is not going to travel with me, I meant I was just planning
to take my wife to reinforce that I will be coming back.

Secondly, if they ask for strong reason, this is what i think I will
answer "I have 4 yrs of experience in the US which brings a value
of very high degree to companies India where I can take core
responsibilities like proj mgmt, business development and client
mgmt. The experience and being local gives me a very promising
future." I am planning to take printout of email communication
that is happening with different recruiters who are requesting
me to take a job at their clients place in india.

What do you suggest would this sound to be reasonable ?
 
The Officer thought that you intend to do same work on B1 visa which you did before H1.

I think you should not try on B1 (work related) besides you can try with B1 visa, reasoning personal belongings....

Taking your wife for b1 visa will not give you good chances....although she is pregnent so it may looks like just because you want to give birth in US for child to be US citizen.....

I would advice try some giving your personal works showing belonging leftover in US, and get B2 visa....

That could be determind by Counselor or CBP at port of entry as visa fraud. think about that before using that reason

P.S. I am not a lawyer and dont pretend to be one.

to go for 3 months. (This 3 months i am not talking about)My wife is not going to travel with me, I meant I was just planning
to take my wife to reinforce that I will be coming back. ( you no need to take her to prove you have wife, it is always possible you can get separated once you are in US. Just argument sake)

Nothing wrong to take some extra papers , but cousnel is patient enough to go through all those papers?
