Please help me analyze the I140 process. :confused:

True or False:

If you get your EAD and AP approved with no RFE then you wont get an RFE for your I140.

First I think there is typo error when you typed ND. I assume it is 2003.

Second, I do not wish to disappoint or sound negative but there is no hard and fast rule that if there were no RFEs before EAD/AP approval, there wont be one before I-140 approval. Have so many cases who received RFEs despite no RFEs during EAD/AP stage.

One of my friend who is from Nebraska center, got his I-140 denied after EAD approval.
 
EAD is like permit to work in the prsent or in the future any type of job with an EAD.
However when RFE is generated on 140 they want to make sure that the employee and employer are sound enough to sustain and maintain the relationship.

The reson is EAD and AP are aproved after an initial look at I-140 to make sure there is no fraud etc. Once it is time for I-140 to be adjuticated, it is looked at with a magnifying glass, if you will. These days almost all are getting RFE's for things like compnais ability to pay, edu evaluation etc.

But getting an RFE is not nessecarily a bad thing. If your documents are in order you will be fine.
 
Even I was told by my attorny that they go thrue i-140 before approving EAD and will not give EAD if they feel that i-140 may not be approved, but this is turn out to be a bullshit when for so many reasons.

so many of my firends got there EAD/AP approved without any RFE and then got RFE on i-140.


when USCIS Account system came in, I saw that my i-140 and i-485 was last touched on Sep 29 2003 (my ND is sep 26 2003), they entered the records of my application that day, if it is true that i-140 would be checked before approving EAD, then my i-140 date must have changed to something near my EAD and AP approval dates, NOTHING.

for some reson my i-140 date changed last week to 05/25/2004 but status is same and no change there, intially i was excited thinking that looks like some one is working on my application ( i want them to reject if they want to but stop playing this painfull game, mine is subs labor and anyways not sure that it will be approved), but i know a guy whos i-140 was filed on ND sep 26, last update date was changed to nov 11 2003 in november and still same msg .........so depressing. :(
