B-2 visa with partner on E-2 visa problem

Hi,

I am currently living in the U.S on a B-2 visa with my partner of 7 years who has an E-2 visa.

I recently successfully extended my status for another 6 months but will have to return home in January as I understand that it is not possible to stay in the U.S on a B-2 visa for more than a year.

The problem is that my partner has recently found out that he will need to stay in the U.S for another year which is not a problem for him but obviously causes issues for me on a B-2 visa.
My plan is to return to the U.K for a month or so and then try to come out to the U.S again to be with my partner.
However, I have a nagging doubt at the back of my mind that Immigration will not allow me to enter the U.S as they will probably think that I am trying to live here permanently. I fully intend to return to the U.K once my partner has finished his work over here but I just don't relish the thought of living alone in the U.K while he is stuck in the U.S for another year.
How long should I leave it until I try to re-enter the U.S? Is there a set length of time that is recommended before trying to come back?

Is there any way around this problem short of marrying him in order to get an E-2 visa (don't really want to resort to that!)

Hi,

Back again!

Thanks for your reply, Triple Citizen.

I was just wondering if anybody knew if the U.S. State Dept program for B2 Classification for Cohabiting Partners is still in place?
It was introduced in 2001 but I'm not sure if it is still applicable or not.

To be honest, this is the first time I have heard of this. You have any links pointing to the pilot program you mentioned took place in 2001?
