Dear friends
i will be very glad,if you can help me with my problem.

We are an asylum applicants since 2003,all this time case in courts, now in court in San Francisco.
We have a very good chance to win this asylum in this court in 2014.

I just was selected for the green card lottery 2014

So i can not do AOS to apply here and i also can not go to my country because of my asylum

My attorney told me that i can apply for advance parole and go to Montreal,Canada to do .

Here is what attorney send to me,i trust this attorney ,but it will be great to have an advice from other prof. people.

,, Hi ......

I just spoke with the government attorney about your case. She said that they are “open” to administrative closure in your case and would also consider writing a letter indicating that they are not opposed to advance parole through ICE. She seemed to feel like the length of time that you and your family have been in the U.S., as well as the fact that you have no criminal records and are working in the theater industry were all factors that would make you very good candidates for what they refer to as “prosecutorial discretion,” which basically means helping you out to the extent that they can -- or to the extent that they think it is appropriate.

Advance parole through ICE would mean that your case would remain open and your April 2014 hearing would remain scheduled.

Administrative closure would probably qualify you for advance parole through USCIS (instead of ICE), but then your case would be “off calendar” and if you needed to put your case back on calendar, you might end up with a hearing date in 2015, 2016 or even 2017.

So those are the two options, it seems, at this point: ICE advance parole (which keeps your court case open) or Administrative closure plus advance parole through USCIS (which results in your case being “closed” but easily re-calendared).

Is this possible to do so?Even if i can have an advance parole, can i have the visa to Canada ?Iam an asylum pending,so out of status?

Or i can use EAC and Advance Parole to go there?

thanks a lot
