AVR after receipt notices of I-485, I-131

Hello,

I need some help. I got receipt notices (I-485, I-131) and I need to go to Canada for urgent trip. I have question, Can I use AVR (automatic visa revalidation ) (short trip one week) with receipt notices I-485 and I-131? I have valid H1B extension up to 2009.

Please some one advice.

Definitely you could with the new I-94 attached to the I-797, the I-797 itself and to be on the safe side an employment verification letter.

All of the above if you re-enter the US within 30 days AND not visit any other country from Canada.

Verified all of the above with my attorney. I will be visiting Canada soon as well.

I need to go to canada...does not have Visa stamped in the passport...does have H1 extended...plan to use Automatic Visa revalidation to come back to USA within 30 days...Now as per state dept website the person using AVR:

a) Has maintained and intends to resume nonimmigrant status

Now I have applied for the green card (I-140/485) which means i do not intend to maintain Non-immigration status....does it mean i cannot use AVR to come back to USA..Please clarify..
