Automatic Revalidation POE

All,

How does the Automatic Visas Re-validation at the POE works for an asylum applicant or someone whose case was denied by the AO and still maintaining a valid F-1 status in U.S.

I would like to go activate my Canadian G.C but I don't want to be locked out  you know what I mean; I continue to wait the decision of my case and so far nothing came up from the AO. And I continue to maintain the F-1 status.

Please share you experience, thanks

I am interested by the answer to that question too.
I was told that you can re-enter the U.S with the old (expired) visa given that you continue to maintain the student status. I do not know about the case of a F-1 student who was denied asylum.

Please help if you can.
I am having difficulties to find the infos about this topic. I really wish I can land in Canada and being back in U.S. right away while I am waiting for the decision from the AO.

I do not think there is such thing as Visa re-validation at POE . Students with F-1 status are allowed to re-enter USA after traveling to Canada (after obtaining Canadian visa) if they did not stay in Canada more than 30 days, did not travel to a third country from there, and also the purpose of the trip was not so you can go to the US consulate in Canada to get visa stamp in the passport ( even though I have plenty of friends that did just that, went for a US visa, got denied, and were able to cross the border back into the USA).

Your Asylum application/denial does not affect your F-1 status, however I do not know how the Canadian PR will affect your future Asylum case in the USA!
Here i want to ask you, how do you know you are denied by AO but you do not have a decision? Also, did you re-apply for Asylum in Immigration court as if you have a valid non-immigrant status in the US at the time of your denial by AO you are not being referred to IJ?

All this said by me is my opinion and not a legal advise! Please consult with you Immigration Attorney for more detailed explanation as well as you International Student Adviser at your school!

RB_ME,
Thanks for your reply. I have not heard from the AO since my interview date. They have not sent the NOID, nor the approval. So I am just considering the worse case scenario.

You are right. We should always hope for the best and prepare for the worst.
