Auto Revalidation

My H1 expired and my company applied for renew. It hasn't been approved yet. I need to go to Canada next week. Can I come back from Canada by Auto Revalidation or I have to wait until my H1 renew approved?

Did somebody tell you that Auto revalidation rule has revoked or did you read it somewhere? If read somewhere, can you post that here?

you're fine to to go on automatic revalidation. just make sure you do not apply for a new visa while you are in Canada and you are not a citizen of a countries that support terrorism (you can find that list online and I do not think India was one of them), just have all the a papers that confirm your current status and current employement and you'll be fine...

Is it OK even if my H1 expired? Do I need to show them the receipt of my renew or just show the officer the old I-797 and I-94? I don't even have my receipt now.

I understand that your H1 has expired, but your I-94 is still vaild, additionally your company has applied to extend your H1 status in the United States, is that correct? Did she you change your status in the US? What is NOA (I-797) for?
 
Yeah, my company has applied for extension. I don't think my status gets changed, still H1. What is NOA? I don't understand this question. Thank you

NOA = Notice of Action. If your status is still current (your I-94 has not expired) you can travel on Automatic Revalidation to Canada or Mexico, all you will need to bring with you besides your passport with the expired visa is a copy of I-94 (you will need to keep the original for yourself, because you are going to need it when you return back) and a letter from your employer confirming that you are still employed. However, if your I-94 has already expired or will expire while you are traveling, they will not let you back into the country on automatic revalidation.

Again, 3 things to remember: you cannot be a citizen of a country that is supporting terrorism (find the list on uscis website); you cannot apply for a US visa while in Canada (Mexico) and finally you cannot travel to the third country from Canada (Mexico) [i.e. you cannot go to Canada, then travel to India, then come back to Canada and then US] -- you will be denied an entry to the US...

well i have a question well if we apply for a visa and have a names check delay ,and have to wait in canada ....but come to the USA on auto validation ,is there a risk ,please help
 
If you apply for a visa and stuck in a name check, auto visa revalidation is not applicable. However, with an approval notice you can use auto revalidation from Canada or Mexico when you did not took a visa appointment at the consulate.

Suppose I take the appointment in Canada with intent to revalidate the visa.
Now after some days I cancel teh appointment (Before travelling to Canada, still in USA) then can I use AVR rule for travel to Canada?
