D. RETROGRESSION OF FAMILY AND EMPLOYMENT CUT-OFF DATES

For August, it has been necessary to retrogress many of the cut-off dates in the Family-sponsored and Employment-based visa categories. This has been done in an effort to hold the issuance levels within the applicable annual numerical limits for the affected categories. Those retrogressions are listed below:

Worldwide: Family 1st (to 01JAN97)
China: Family 4th (to 01JUL94)
India: Employment 2nd has become “Unavailable”; Employment 3rd (to 01APR01)
Mexico: Family 3rd (to 01JAN81) and Family 4th (to 01JAN93)
Philippines: Family 2B (to 01DEC92) and Family 3rd (to 01DEC85)

E. IMMIGRANT VISA AVAILABILITY FOR SEPTEMBER

Immigrant visa number use is approaching the annual limits for the year in many categories, and the supply of numbers remaining for allocation is limited. Therefore, for September there is increased possibility of additional retrogressions of cut-off dates such as those experienced in August. Readers should not assume visa availability until the cut-off dates are announced. Categories which could experience retrogressions are:

Worldwide: Employment 4th
China: Employment 2nd and 3rd
India: Employment 1st
Mexico: Employment 3rd

EB-2 is UNAVAILABLE (including NIW and people who are going through labor certification). the more the delay in releasing VB meaning more RETROGRESSION we can anticipate because USCIS works so hard :eek:

Last year they gave sudden shock by retrogression in sep bulletin
this year they are planning slow so it came up in august
there is indication that eb1 for india might get retrogressed next month
Eb2 india is already stuck
EB2 china is next to get retrogressed

Well......my suggestion will be to hold on till NOV 2006 when things will start coming back for Eb2 and Eb1 guys...................these months are always like this...but this year it just came early!!

Hi Eb-1doc,

I am not shocked by seeing this month bulletin. Because it is quite unusual that VB comes out so late. that is what I wrote the more the delay more retrogression ahead :(

Well, it is all going as predicted.
but Eb2 and Eb1 will move faster once new quota year begins!

Well.........what r u doing here eb1doc.........you are still hanging in there!!!
now i am scared ,....i had applied eb2 niw then eb1 got eb1 approved now they say they will retrogressed eb1..........isn't that scary!
 
yes, the situation is very very scary for educated people like us.... How long one can hang in a position like a postdoc? If you need to move to industry it is rather impossible in this type of situation.... thoug you could easily get a job!!!

really!!!
You know ..they say its only till you get it is wanted...........before getting GC you are competeing with different guys and after getting GC you are altogether in different competitive world...........specifically talking .........i know many of my friends after being postdoc on H1b also got faculty positions on H1b..........i beleive you need to be competitive ................I may be wrong but its my opinion!
 
EB2 NIW from July 2004... Worth applying for EB1-OR?

I have an EB2-NIW approved in June 2005 (applied in July 2004). The I-485 has been pending from July 2004. We have the EADs, the Advance Paroles, etc., so we feel fortunate that we didn't hit retrogression before we filed for I-485. However, the uncertainty due to retrogression has been a bit painful. So, I was wondering if it makes sense to apply for EB1-OR now.

If the EB1-OR gets approved (I think there will be a good chance), can I just attach the new approved petition to the pending I-485? Would there be any issues in transferring the EB2-NIW's priority date to the EB1-OR? Is it worth the time and effort (approx 2 months to prepare the I-140, and the wait time for the approval... plus whatever time it takes to update the I-485).
