Attorney Murthy's speculation on I 485

It is just that ! Speculation !

I cannot believe that they could place a statement like they did based only in 2 cases and a response given by the Customer Service Center !

Probably most of us had the lousy experience of interacting with the Cust. Serv. Center. We all got confusing and mistaken responses from them.

I consider the I485 update given by A. Murthy very unresponsible. By the same token, I could said that NSC is now approving all concurrent cases in less than 10 months because OctFiler was approved in 7 months.

We do not have enough information to conclude anything at this point, but that Murthy was very unresponsible on this statement. :mad: :mad: :mad:

I agree with Elnegro. I have this to say to IndiKiddo, the point is that by making such statements she is scaring the hell out of I-140 filers. She has a reputation and what she says can be taken by many as 'truth and the whole truth'. If I or you are to make such a statement, that is fine as we are not experts in legal term and no one relies on our word to make future desicions, but people may rely on her 'staements'.

I think it does to many people who are anxious to get their 140s/485s approved. It creates confusion and loss of hopefulness. You expect professional and responsible statements from a site like that.

how to verify the genuineness of this news?

The latest update from NSC as on murthy.com is really dis-appointing.

Earlier, the memo said that for concurrent cases, processing dates will be based upon I-140 processing while this one says that it is based on I-485.

All of us have different attorneys and I doubt how many of them are aware of this new update (even if they visit murthy.com, will they believe this news?)

Who will clear our confusion? Can we atleast plea to clear our I-140, I am in no hurry to have the I-485 cleared, just NEED AC21......

If you want to conclude that this is a trend, based on 2 cases, out of hundred of thousands, you can feel free to do it. By the way, I suggest believing that we will all be approved in 7 months like OctFiler. At least is a more optimistic point of view.

I also believed on fairies, until the INS witch showed up.

If you had understood the title of my posting to which you replied last, I guess then you'd concluded that I did not loose hopes.... :p

All I mean to imply is how do we verify the authenticity of this update.
If you call USCIS and try to verify this with them, will they confirm? You BET!

The update is aunthentic, the content has no basis :)
The only people to talk at USCIS that I know of are the Cust Service Reps... Good luck :eek: :eek: :eek:

I am not so sure. If you consider the response octFiler got to his query of his wife's status, it is pretty much the same that murthy has posted on her website.

I know that Murthy has a reputation for speculating based on USCIS response but I feel she may have a point here. I see no motive for her to scare people. I am not going to switch attorneys because of one update. Better be aware than not.

I am just having a very hard time on the way she got to the conclusion. Based in 2 cases. This is not a USCIS statement or memo or nothing. Just the response on 2 cases. Lets see what happends during the next 30 days and we will see...

Octfiler's case is against the premise of the analysis of Murthy. However one has to just see the situation of the other 140 filers from Aug, sept, oct who are still waiting for 140 approval. Why has not the 140 cases of concurrently approved filers not getting approved fast enough? Becaue USCIS is waiting for the 485 case to be ready. Yes it goes against the spirit of Ohata memo in way. The memo states that the 485 will be tracked by the 140 date and hence if the 140 date is crosses, USCIS would take both 485 and 140 and approve simultaneously. However what there is BIG IF in th eOhata memo that USCIS is exploiting and that is the readiness of the 485. USCIS can sit on the 485 case even after the FP and Name check is ready. Nobody can question since nobody can initiate an inquiry till the date has crossed, BUT WHICH DATE? Since there is no guidance or memo issuing directive on inquiry handling of pending cases, USCIS can comfortably take shelter under the umbrella of confusion.
I am surprised that a few filers like Octfiler got thru. In the month of may, june I was hopeful about more cases like Octfilers. But now I think Murthy may have a valid point. BTW, my 140 /485 RD: Sept 27,2003. Awaiting approval. NSC, labor: Minn, FP done.

I know it is pretty tough for many of you out there waiting for 140/485/AC-21's etc......and hence have been speculating and wooried about some other speculations.

Before my 140/485 is approved i posted in some other thread stating....be patient NSC might start pouring in near future ........I still beleive in that...guys look at it like this.....even if FO memo was not there then at the most they might be approving oct/nov 140's by now but because of FO memo everything stopped and insted all of you will get even the 485's approved...in near future ...may be by october/november ..which means if the FO memo was not there....ur 140's would have been approved in july/August so the difference being 3 or 4 months and in those 4 months u r getting ur 485's approved so be bit patient and both ur 140/485 should be approved.......

Some of you migth think..now that my case was approved i am talking like this ..please dont think that way i am just trying to be bit optimistic for u guys and sincerely praying that all of u waiting for long time should get ur approvals soon. Dont worry much about the speculations made in other sites.......

Very good and valid points. BUT, how could you explain expediting the FP process, asking for 485 RFE, etc, etc to recently concurrent filers, IF NSC would not have the intention of concurrently approving 140s-485s?

Thanks Octfiler for your optimism.. and all your replies.. do you have any predictions or thoughts about I-140s which have been approved.. for instance.. my concurrent Aug 2003 I-140 was approved in march 04.. do you think my 485 will also be approved by Oct?
